Repatriation - Do I entitle to claim the full amount of the air fare to return home?
"According to Article 57 of the Labour Law, upon termination of the employment contract the employer shall at its cost return the employee to the place of recruitment or to any place agreed upon between the parties. The employer shall complete the proceedings of returning the non-Qatari worker within a period not exceeding two weeks from the expiry date of the contract too. When the worker joins another employer by sponsorship transfer before his departure from the country, the obligation of repatriation shifts to the new employer. Hence the worker has no claim for repatriation travel charges unless otherwise agreed mutually."
Refer to the article above copied from Legal Helpline@Gulf Time,do I entitle to claim the full amount of the air fare to return home?
(I have an Employment Contract that stated In case of resignation before the expiry date of the contract, the employer shall be exempted from the payment of return expenses of the worker!
But.... 1st paragraph did mentioned " the duration of this contract is indefinite commencing from XXX date ..."
and it did mentioned as well that, the employer is liable on the responsibility to repatriate the employee after the completed 6 months service....
so , are they contradicting ???
Yes, they will not... i have an unlimited contract but for the purpose of local regulations they have indicated 2 years ont he contract. I had the same clause as you which i asked them to remove.
NO, WHY? AS PER YOUR CONTRACT STATED:
Employment Contract that stated In case of resignation before the expiry date of the contract, the employer shall be exempted from the payment of return expenses of the worker.
Based from what is stated in your contract, yor employer will be exempted from the payment of your return expenses if you resign without finishing your contract. for most companies, they will not also give the gratuity pay if you did not finish your contract. gratuity pay are given only for those who finished they contract.
Err, if I'm reading this right, the answer is no.
