Anybody please help me

Hi there, it's me again. I've just getting better after that road accident last April 15, 2009 at old Ras Lafan road. People, I really need your advice. I was about to claim my accident insurance after I acquired the Hospital reports and papers from the white palace(Hamad), but our company refused to talk about it. This sounds like they will not settle this things off. Now, where should I go to clarify these all, after all we (the victims) suffered several injuries and couldn't get back to work as of now still couldn't claim any insurance or benefits.

Very unfair to hear how our company acted like this. Leaving us with scars and injured body.

Please, do give us options to correct any mistakes on this situation we faced.

If one of your colleagues died as a result of the accident, then the Labor Law stipulates that he is entitled to receive compensation, which shall be calculated in accordance with Islamic Sharia.

I recommend you discuss his case, and yours, with the Labor Dept, who are the most experienced in these matters, and can take action if appropriate. The right to claim lapses 1 year after the date of the medical report.

if u r in the company vehicle and were coming back from work going somewhere (to work) that means to be considered as accident in duty time ..

and the insurance company should pay for that ...

in the following cases:

1- death

2- permanent disability in all or one of body organs

if u r ok .. then i'm afraid to say that they paid for the hospitalization and ur salary and u have nothing more to ask for .. i'm really sorry for what happened to u and ur colleague but this is it...

Oh my.... if Accident insurance is optional, how petty we are. I might regret for some reasons. Hope it is not this bad... Much more to the dead one that leaves his wife and 2 year old kid....

What is it you are asking for exactly? For the company to pay your hospitalization? Yes, of course they should. You are receiving your paycheck each month - what else are you claiming you need payment for? If you are asking for some sort of compensation above and beyond medical care and salary I'm afraid that's pretty unknown in the Gulf. Disability insurance is optional and paid for by the employee in other countries. I suspect it doesn't exist here. Sorry.

Actually our work time is 6 am to 2 pm and that happened at between 12 to 1 pm. We came from Al Ruwais Port( Customs Office) where we got an X-ray machine under maintenance. It's our company pick-up that we usually use for work. I was confined at the hospital for 3-4 days due to deep head lacerations and broken nasal bone, but they discharged me and do regular follow up check-up at a given schedule. As of now i feel better but off the heat because of what i suffered. As for the others, we can not work. We do receive our salary every month. But I am (we are) not as good as we were before.

There is a whole section on Work Injuries and Compensation in the Labor Law, but it's hard to comment on your specific case without the facts.

a) Were you on duty at the time of the accident?

b) Were you travelling to or from work?

c) Were you in a company vehicle?

d) Have you suffered a permanent disability as a result of the accident?

e) How long were you actually off work and did you receive pay for this time?

If in the agreement, it is mentioned like 'accident only from work site', then no chance !

i just came from our office, they told me that our insurance company only covers accidents occurred on the work-site not on the road(even if it is still working hours 12 noon). The insurance company from the other company would be our best bet to claim. Very poor to think, that even though one of our colleague died instantly on that time, still can not claim any from our company's insurance except for salary and over times.

unless the insurance policy has been expired ..

or they know that the insurance company will open a case so that the company will pay a certain amount and the rest will be from the insurance company ...

Talk with your HR dept..

What your company to lose for that ? It is insurance co. who have to pay for you, not your company. Anyways, your company is paying a certain amount to insurance co. and why they are much bothered ? strange !!!
