I BADLY NEED HELP!!!!

Reaz
By Reaz

Hello to everybody

I have been in Qatar for almost 2 months now and during the past month ive been falling sick n my health is keeping on deteriorating. I gave my resignation letter on 11 Oct for my last working day to be 31 October as i am still on probation but my employer is not willing to release me.

I am having the following problems:

- Respiratory problems. I find it difficult to breath and at times i am breathless.
- I am also having gastric / acidity problem. Done endoscopy yesterday and the doctor told me there is lot of acid and scars/lesions just after my stomach. This is preventing me from eating well and i have lost around 6 to 7 kgs in 3 weeks.
- I am very weak and am forcing myself to work as my employer told me that i must complete the current job i am doing for him to release me. This job will take at least another 3 weeks to be completed.
- I also got skin problem and the dematologist told me I have contracted scabies (parasites).

Accoriding to my contract, if i leave before having completed 2 years, i must reimburse the company for its air ticket etc... which i am ready to do. Even asked them how much i must reimburse and they have not told me yet.

Can some1 pls help me as to what i must do so that i can get to my country as soon as possible to get me treated there. Here, i am just living on medicines and not getting any better.

Thank you for your help in advance.

Mr Sayed Ali Zakir on QL advised me to go to the Ministry of Labour or Ministry of Interior and logged a complain. Will they take me seriously there or take the side of the employer as me I am just an expatriate here.

if he is unable to work or his life is at risk if he complies with the contract, then the contract is considered void.

you are still on probation you should not have to resign. I said before but it appears to have been overlooked, probations works both ways. You can leave at the end of the probation period, it isn't just the company that has the option of releasing you. Probation works both ways.

my dear friends, i would like to know the following:

1) As in any other country, do i have the right to resign from my job in Qatar?

2) Can they force me to stay and complete a job i am doing despite my health problems?

On Sunday I am planning to inform them that as per my resignation letter my last working day is 31 Oct and as such I would appreciate if they let me know how much I must refund them so that they can start the procedure to get my exit permit for me to go back to my country on 01 Nov as I will not work as from 01 Nov.

Thanks

the embassy of my country is in egypt...send them an email and waiting for their response...

I do not know if it is a wise idea i've just got...But as i gave my resignation letter on 11 Oct for my last working day to be 31 Oct, I am thinking of informing the manager on 31 Oct that as from 1 Nov i will not be coming to work as my health is no longer permitting me and its better of they arrange for my exit permit... U think its a wise idea or this will lead me to more problems...

period is a two way thing.

Not only can the company "not keep you" but you have the option of "not keeping the company".

On too many occasions people assume it's only for the company's benefit.

I just cannot understand the whole stuff?? You are ill, and you're asking your employer for an exit visa to go back to your country. He refused. What the hell is that? I'm speechless now. Well, I certainly need more details to be able to have an opinion. It's quite strange.

Char if you need assistance I would be ready to help.

I got a telephone Number of HRC in 13th street Industrial Area: 6626663.

Don't know if it's useful to contact them by phone. but it could be useful.

i went to the HMC. I vomitted and there was some blood. I was very surprised when the doctor there told me to come see him again if i find blood in my vomit again.

Go to HMC and admit as an in-patient. later the doctor will examine you and certify that you not fit to work (medicaly condemned. with that you employer has no choice but to send you back.

according to my employer, when i told him my problem its just like a fun stuff for him... every problem i am having, even weight loss, is not serious for him...

on top he is imposing that i must complete a work before he let me goes...but to be honest with you, i am not sure that even if if force myself to work despite my ill health he will release me if i complete the work (which may take 3 weeks)....

i am alone here and do not want to get in more trouble by contacting Labour office n lodging complaint just in case they wana side the employer..

i am losing weight and despite this, due to my acidity problem, the doctor gave me a laxative...my God will i not lose further wieght due to this...also my drum after stomach is deformed and inflammed...

I am sure if you approach the Labour Office and take a certification of health that they will advise the sponsor to release you or perhaps organise the release itself. I would not bank to much on the HRC as they do not like to get in sponsor employee issues assocding to my knowledge. However, you are of ill health and of no physical use to your sponsor what is his reason for keeping you?

By Reaz• 25 Oct 2007 14:31

also, during my probabtion, they can give me only 3 days notice to stop my services...so i think the 2 weeks notice is sufficient...pray for me that they release me at the end of Oct my friends

By Reaz• 25 Oct 2007 14:30
Reaz

thank you

the HR manager said that as i am still on probation i do not have to give 1 month notice but less, so i gave them 2 weeks notice... the only obligation i have with the company is to refund them for air ticket and other costs which i am ready to do...but still they are not telling me how much i must refund them

Reaz, Contract is a legal document between Employee and the Employer .. you have to give I month notice as per the Contract. Then it is up to your Sponsor to release you immediately or anytime during 1 month. But they cannot reject your resignation unless there is any legal issue, which can stop you leaving the Company and the Country in general.

Wish you get well soon and early release.

thanks

i have anonymously write to the NHRC and also to my country's consulate which unfortunately is in Cairo...

If i have given my resignation letter, can i stop working as from the 1st Nov even though they are not letting me return to my country?

Coz in my country, I have got my family and also here as i said i am having serious skin problem also.

Thanks for helping me

The contract says i must give 1 month notice when resigning. Bt the HR manager said that as i am still on probation, i can give less that 1 month notice and I gave 2 weeks notice

National Humar Right Commission... I think if you search on the net you can get their contacts...

If the contract says you can resign during the probation without notice, you can do that as per the contract. If your employer stops you, you can go to labour ministry...
