Hi,

I joined as Account executive in XYZ Company based in Doha in April 2012 and working with them till now.  My initial contract was for 2 years. 

Recently due to company restructuring I have been told that April 20, 2016 is my last day with the company. 

I started looking out for job and luckily I got a job offer in ABC Company. 

Now my current XYZ Company is not ready to give me NOC. They are just delaying and not confirming if I will be getting the NOC. Also not sure if I will get my PF/Gratuity amount from the company which is around QR 25000.

 

I have following questions

 

  1. 1. What are my options if my current XYZ Company does not give me NOC. Is there any way I can appeal to get this.
  2. 2. If the company does not give me NOC how long can I stay in Qatar.
  3. 3. What if company doesn’t pay me my PF/Gratuity? Is there any way I can appeal to claim this
  4. 4. If I don’t get NOC how long do I have to stay out of this country and come again to a join new employer

The answers:

1) If the ABC company does not give you NOC, there is nothing you can do about it. There is no system of appeal.

2) I do not have any idea on this but if your company stamps an exit visa on your passport, you must leave withing seven days or face a penalty for each extra day of stay.

3) Yes, there is way to get your End of Service benefits if your company refuses to pay. Just lodge a complaint with the Labour Office. The procedure is very simple and the Labour Office will force the company to pay. Their action is also very fast.

4) If you do not get NOC from your current employers, you will need to stay for two years out of Qatar before you will be able to return on a new visa. This is as per current rules.

i stand to be corrected but as far as im aware due to the human rights implications involved should a person be terminated the company has to provide them with an NOC- BUT as suggested take it up with the ministry of interior and Ministry of Labor and Social Affairs

If I may.

If the ABC Company has offices in UAE, they can give you a work visa and from there get a business visa for Qatar. The ABC company can work on your Qatar RP thereafter.

you can approach the AlJawazat (Immigration) and request to extend the visa for two months in order to finish all your correspondences like claim for PF/Gratuity

@britexpat - Thanks for the reply. Labour court where and how it has to be filed. If I dont get my NOC then I will have to leave Qatar so how can I do that staying out of country.

Please guide me if you are aware of the process.

The employer is not obliged to give you an NOC. All you can do is ask and hope they comply.

If you do not get an NOC, then as per the current law, you can't come back for two years.

If they don't pay you your dues, then go to the labour court and file a case.
