Working for 8-months is entitled for Gratuity and Annual Leave w/ pay?

Please help me to clarify this issue.
I've been working with my company for 8-months, then i resigned. My question is,
1. Am i entitled for Gratuity?
2. Am i entitled for the Annual Leave?,
Is there any written in the Labor law for the entitlement of the above?
Hope anyone could answer my querries.. Thank you.
You can get your annual leave pay after completion of
continuous 12 months work in the company.
I have a question,what if i didnt take my vacation
for three years?am i still eligible to take the 3
years annual pay now that my contract ends? The sponsor
denies me of my claim, saying it is good as forfeited
since i didnt use it. I didnt read any of her explana-
tion in the revised labour law but im confused what
this article 81 all about..Please enlighten me..

You are NOT entitled for both. Here is the law:
GRATUITY-......the employer shall pay the end of service gratuity to the worker who has completed
employment of one year or more. This gratuity shall be agreed upon by the two parties,
provided that it is not less than a three-week wage for every year of employment. The
worker shall be entitled to gratuity for the fractions of the year in proportion to the
duration of employment.
ANNUAL LEAVE-... The worker who has completed one continuous year in the service of the employer shall
be entitled to an annual leave with the pay provided for in Article (72) of this law. This
leave shall not be less than three weeks for the worker whose service is less than five
years and four weeks for the worker whose service is more than five years.
Yes you are entitled for gratuity on prorata basis for 8 months @ 21 days/year and same for annual leave.
