company problem need advise

i am working in a fashion ladies garments and my company accused me that i stole some clothes. my manager give a report to police and bring two people as a witness that they saw me that i stole something, but i didnt take any clothes. after they give the statement in the police my manager took me from my workplace and drop me in the police station. i stay in jail for 2 days and ive been schedule for interview in public prosecution. when they saw that im not guilty the police has decided to let me out in the jail but they say the case is not yet finish. maybe after 2 weeks or 1 month they will call me again for another court trials. now im free but my problem is i cannot comeback to work because maybe they will do some problems about me again. my problem also is my company dont want to give me a release paper and they want me to stay at home until the case will finish... anyone can give some advise for me about this? how can i fight for my company? is there any possibility to do? pls help me by making comments. especially kabayan... kabayan ako pare ang hirap ng walang kinikitang pera. comments na mga pare at mare!!!

Here is what you can do:

Take the advise of the QLers and go to your embassy and seek help. I'am not sure why you got into this situation but looks like your employers don't like you for insisting on a salary hike/promotion and they are trying to frame you. Also, you have not done a very wise thing in creating this id on QL with your name ( assumption here!). You need to be very very careful coz I have seen a few filipinas getting into real trouble with the employers due to hasty decisions. Get yourself a lawyer if you can afford one asap.

know your "rights".

you have the right to remain silent, anything you say shall be used against you...you have the right for an attorney...and so on and so forth...

whatever your case is, may you be in good or bad faith, still you have your "rights" that you can invoke and exercise until you are proven guilty beyond reasonable doubt by "final judgment".

the best you can do is to, yes i pretty much agree, stop publicizing your case coz you'll get good and bad responses which will only lead you to more confusion.

make very good use of your time. ask legal advice discreetly but don't be too trusting. know the people you open up to and be very careful coz some might sell you out.

study their laws and by-laws.

in the court no, but in the police station yes. i want to tell this but they dont listen. only they want is to answer their question. they dont want me to explain just yes or no. any way thanks for every advise that u gave me, and sorry for other who doesnt like it, im just want to understand what will gonna happen coz im really afraid.

emmanuellepvillena, did you tell the courtthis about this fact, that your employer created this case after you asked him for the release? It is very important.

but a little advice, stop talking about the merit of this case here. You are talking a one-sided story and in as much as we wanna believe you, it is till the court to handle final judgment. Just be thankful that you are out and make effort to win back the trust (although as per your story, it's all fabricated scenarios), of your company. Maybe they will finally give you a release (release to transfer or release to go home). Either way, you are free, from them. IMHO!

it happen like this sir, its been 2 and a half years that i am working from this company and everydaypass by im waiting for promotion that can be increase my salary but until now they dont give it. i tried to apply in other company and i got lucky when i got a job offer that it will be double the salary as a take. I show it to my shop manager and he said that its impossible to give me a release but i inssists that i will go to the labor if they wont give me. after 3 days when i am working, he told me that we will go to the police because they need some statement from me, when we came there he left me, thats the time i go in prison. the police translate the police report its written in arabic, saying that 1 week ago i take out the clothes and i pull the security alarm so that i can pass the gate without ringing the security device. so he take 2 people to be the witness that they saw me doing that. in my side, its easy to take a people who can be a witness and tell any stories they want. and also why in that mention time and date they dont catch me in actual when im going out... why they need another week to make a police report

thanks jackmohan... but anyway ithink my manager do that kind of stories because ive been employed in my company for more tahn 2 years and he promis me a promotion of work but he did not give, after that i show them that i have offer in another company that can make my salary double and he said that they will not be giving any release. so, i said that i will go to the labor if they dont want me to give a noc. after that, it happened as i mentioned above.

To somebody reading about this, most people would think "Why would your company accuse you of stealing? and even found TWO witnesses if you didn't!!!"

Nobody can blame them for not wanting you, and not wanting to give you NOC.

If you are innocent ..and the guy is trying false witness against you ...you could go to labour court.

Now the verdict is in your favour as the police did not find you guilty. You can claim what ever the company was stealing from you like the "promised salary" from which the "food & bed allowance" was cut.

But as Bleu said why did he accuse you of such a thing?

case is on going ,they won't give you a release.let's just hope it will be over soon in your favor and you might go back to your job again or give you the release you were asking for or whatever decision they decided to give you. it all depend on the company.

with regard to release paper, you can fight for it but winning it is impossible...it is still the employer's prerogative to issue a release paper...just follow first all the advice mentioned above...

POLO/OWWA .they might help you and do something about it.

And make sure you are ready for the next hearing to prove that you really are not guilty because you said that the case is not over yet .

your only chance is to have a lawyer! And no need to discuss your case here because it's already in court! Talk sincerely with your supervisor and company representative!
