DOHA • Male lawyers in Qatar are opposed to women being appointed as judges and say if at all, they should be restricted to family courts.

A woman is emotionally and physiologically not geared to fit in the role of a judge since the job demands a balanced disposition, said Waleed Abu Nida, a lawyer.

Women are showing excellence in almost every field in Qatar and walking shoulder to shoulder with men, but dispensing justice is not their cup of tea. "It is entirely the male's domain," said Lawyer Mohsen Thiyab Al Suwaidi.

"We, however, support the idea of women judges in the family courts," he said. Women are physiologically not geared to be in a judge's role since their performance can be affected during menstrual cycle, pregnancy and delivery," argued Al Suwaidi.

The Peninsula was seeking the views of the legal fraternity on whether women should be appointed as judges in the Qatari courts after media reported yesterday the UAE had decided to have females in the profession, triggered a debate here.

According to Abu Nida, even if a woman is picked as a judge, her performance would be good for a limited period. "It's rare to have a female judge with a stable track record throughout her career," he said.

Isam Mehfooz, from Mohamed Nasser Fudala's Lawyer's Firm, said he was not opposed to women being inducted as judges but quickly referred to the family courts where he said he saw a more important role for them.

As for criminal courts, Mehfooz said he didn't think that would be the kind of court where a female would be able to fit in as a judge.

"I think there are enough signs here indicating that women may soon begin entering the judicial profession. The number of women lawyers is increasing and, recently, a female has been picked as a Public Prosecutor," said Mehfooz.

Having women as judges in the Arab world is not a new development, according to Abu Nida. "Five months ago, a woman was appointed a judge in Egypt," he said. "But they shouldn't be. They are emotionally disposed which can be disadvantageous for a judge's job," argued Abu Nida.

Historically, all religions in the world are opposed to having females as judges, he said.

There are verses in the Holy Quran and some Hadith (Traditions of the Prophet-PBUH) against women being appointed as judges, Al Suwaidi said.

But a woman lawyer, who asked not to be named, was highly critical of her male counterparts and said their opinion that females should not be allowed to become judges was biased.

"A judge has to base his or her decision on points of law and evidence, so where is the question of emotion and physiology being involved in it. There is no reason why we can't become judges," she said.

A senior sales executive who was told by her employer that she would be “useless” after she became pregnant could receive up to £200,000 after winning her sex discrimination claim.

Louise Manning was told that she would “never be the same again” after her boss learnt that she was expecting her first child. He later sent her a memo saying: “Feel betrayed . . . Tempted to dismiss and take the consequences.”

The level of damages will not be set until next month, when the tribunal in Ashford, Kent, will also hear a separate claim that she was a victim of constructive dismissal. Mrs Manning, from Chelmsford, Essex, said after the hearing: “This has stymied my career. I found myself in a position where I had to resign. There was no way I could go back to work.”

Before she became pregnant, Mrs Manning was earning £55,000 a year at Safetell, a supplier of security systems based in Dartford, Kent.

In its judgment, released last week, the tribunal found the firm and its managing director, Nick Medlam, guilty of 24 instances of sex discrimination. It ruled: “It is not often, these days, that the tribunal is faced with such a blatant response to notification of pregnancy.”

The company denies Mrs Manning’s claim of constructive dismissal.

Throughout this thread, posters mentioned about intelligence and compassion/emotion between men and women. What about "insight", "perception", or "intuiton" -- almost sixth-sense. Many women have this gift or "radar" that men don't have. Women can "smell" a deceptive person while a man is thinking "He's a cool guy!" This mostly deals with rational stuff but also with a beyond the rational senses. I'm convinced that many women have this ability (or "gift"). My wife has it in a big way. She's always coming up with predictions or reasons to do this or that or to trust him or her (based on her "gift of perception").

If more lawyears or judges ahd this ability, justice would be served. If more women have more of this ability...........need I say more!

not the first time that I've heard comments coming from the Qatari judicial system which indicates mind boggling inadequacy. As it is, I suppose their insecurity must be giving them sleepless nights... without having to worry about the fairer sex taking over their jobs!

Corne...I agree with the dumb acting women being disgusting. Had a niece who was super intelligent but she would put on this stupid blonde act (she was beautiful also!), because she got the same reaction you did from guys...that they were afraid the woman would be more intelligent than they were...Just to hear her voice and what she said would make me stare at her in disbelief..it was like she was a split personality!! She graduated with honors from a major university, in engineering...go figure...

it is...the competition, or what they FEEL is the competition is too much for their egos. BUT...when you find a confident man who can have an intelligent conversation with you and be proud that YOU can have an intelligent conversation with anyone...he's a keeper!!

On Madame Curie...I know..but look at the history books and see how many people died due to the radiation when they were trying to figure out its properties and benefits. We have to thank them for their selflessness or we'd never have things like x-rays or chemotherapy.

Sucks though that she died because of what she loved most. She used to carry around the radioactive test tubes in her pocket and stored them in her desk drawers, and ended up dying because of too much exposure.

In fact..right before delivery, you get so much done because you are doing what is called "nesting"..where you take everything out that is in disarray and re assemble it in a neat organized manner...

I think sexual discrimination should be illegal, because ur basing stuff on the persons gender rather than abilities, which isn't right.

As for will it take Qatar 30 to 40 years ? I think it's going to take much less, cause of the huge educational movement happening in the country.

Anyone have an opinion on the second part? ie sexual discrimination being illegal?

£200,000 ($400,000) fine for sending a memo suggesting that the woman could not do her job properly because she became pregnant. The attitude displayed in the 1st part is like that prevalent in the UK in the 60s and early 70s, it took the Womens Movement and changes in legislation to arrive where it is today. Is the same thing possible in Qatar in 30 or 40 years time?

ditch the pom poms and get up on my soapbox with me...let's do some telling it like it is, hon!!!

Just recently..as recently as 1970, women were fighting for their rights to work and be paid the same pay as a man who did the exact same job. It was a very long and hard fought battle...and to this day, even some of the jobs STILL don't pay what they should..called a glass ceiling, for women. Looks good on paper, and that's about it. Men said that women couldn't do traditional "men" jobs, such as CEO, firefighters, police officer, electrical line repair, etc...but it was shown and continues to be proven that we can and often, do a much better and more through job of it than the men. Taking over a traditional male job tends to scare the pants (sorry for the pun!) off those men who are insecure about themselves or KNOW they aren't doing the job as well as it should be done...so therefore they insist women aren't qualified to do certain occupations. So..its basically fear...

It's such a stereotype that all women will be ultimately influenced by their emotions and won't think straight. That's not true. I've met plenty of women who are more capable then any man. PMSing doesn't mean the woman will become a complete emo queen, I for one, am not affected by it at all and I'm sure there are women like that as well. But the judge rules by the evidence provided and the proof given rather than the emotions, so if a woman works according to that logic, why wouldn't she be able to accomplish the job ?

And, its NOT nature..that's considered nurture..how they are brought up to believe they SHOULD act. or whatever she's called, she's one tough judge, i have to admit,,but here in the Gulf, it's different, a woman can never bear the sudden emotions, shocking decisions and accusing during the day...it's nature!!!!!!

Yet a man on the other hand is capable of such things..my dad's a lawyer, and he himself wouldn't agree either..

Well women in general are not put in those kind of powerful chairs due to certain basic reasons. (its a world over scenario and not particular to ME).

* She is most of the times honest (i mean no under the table cash exchanges)

* U cannot manipulate her the way one can do to a male member

* She is more practical in giving verdicts.. means a rape case will not most of the times make a victim prove her innocence and the culprit is happy digging the victims past and what not.

Now come back to ME:

If she does not conduct a fair hearing.. she is gonna get not a slight lash but a good number of lashes from her hubby.LOL

Saying that women are not physically capable (or mentally capable) of being a judge is absolutely ludicrious.Mosts likely its a feeling of their territory being invaded by females, that is the problem. Its a tough issue for males to handle as seen everywhere..We had the same issues in the States many years ago..but perserverance and intelligence prevailed and now we have many very good judges and lawyers who are females.

Ummm ya a woman's performance would be effected during delivery, you try doing a job whilst pushing a watermelon out between your legs. :P Persumably this twit meant AFTER delivery, and if he didn't (or even if he did) it shows you don't have to be smart to be a judge in Qatar so I don't see why you'd have to be emotionally stable. :P
