False Rape Claim - Is This Justice

A 16-year-old girl has been jailed for falsely making a rape claim so her boyfriend would not discover she had cheated on him.

The girl, who had consensual sex with a 20-year-old man after a night out, told police that she had been abducted and attacked by three men, Merthyr Crown Court heard.

It led to all three being arrested.

The girl, who admitted perverting the course of justice, received a six-month custodial sentence.

The judge ordered the girl should not be named even though three men she accused were identified in court.

If she had pulled this off, that man would have gone to prison for a minimum of 4 years, and had his entire life ruined.

My (undoubtedly) controversial opinion, is that she should serve the same sentence (4 years minimum) that her victim would have had to serve, not 6 months.

And if you read the full article, you will also be able to see how false claims make legitimate cases more difficult to prove.

LOL. I concede as well that having his name on the sex offenders list would be horrible, and I think she should actually have her name put on it. After all falsely accusing someone of rape is a sex offense in my books.

LOL. I personally have no faith in sentences for rape, especially in the UK where they seem ridiculously low for the seriousness of the crime. Rape is still a crime that isn't taken very seriously anywhere in the world,sadly.

But, another thing the judge probably thought is that very rarely can rapists be rehabilitated and once a rapist always a rapist. Whereas 6 months or even 3 months in juviie with some real criminals will probably be enough to set this girl straight.

There's a lot of background we don't know anything about.

Well to be honest Pilgram I am going to shut up and wind my neck back in, because the more I look into this the more uncertain I become. But I still believe he would have got more than 6 months, and his life would have still been destroyed. Rant... Rant.. Rant.. boy am I on one today.

Well there's the rub timebandit, who knows what he would have got if the case had gone through. 4 years is the MAXIMUM and probably only applied in cases of violent rape. My guess is he never would have gotten more than 2 years anyway, especially since he had no prior convictions. In the end the judge probably gave her 6 months cause that's all he would have ended up with.

Errrr.... correction... having just done a little more research, if he was 16 it looks like he would have got 2 years. Oh heck who knows what he would have got. Anyway the mandatory tariff for rape after 18 is 4 years and that is what he would have got and his life destroyed. She is still only getting 3 months and yes probably in a young offenders holiday camp.

I understand that timebandit, but if I remember correctly from other British cases he wouldn't be sent to an adult penitentiary underage.

Keep in mind as well, he's welcome to take her to civil court now and sue the pants off her.

The tariff for a four year sentence means that he would have had to serve a minimum of 3 years before being able to apply for parole. A sentence of less than four years means you automatically get released after serving 50% of your time.

He would have been sent to an Adult prison with a wing that specialises in sex offences. He would also have been placed on the sex offenders register for life, which would make it nearly impossible to get a job, and have a normal family life.

She is only going to serve 3 months and that's it.

Well if he would have gotten 4 years, so should she have...granted in either case they'd probably be out in 6 months anyway.

Pilgrim you are wrong on this occasion. 16 year old boys convicted of rape get the same 4 years that an 18 year old would get.

This was an evil act by this girl that could have destroyed a mans life completely. She should have got more than 6 months. She should have got 4 years in my opinion.

I think the fact that she's 16 has come into play here. The other guy would have gotten 4 years because he was over 18, if he was 16 he'd have only gotten around 6 months as well.

and a NON-BAILABLE offense. So if a false claim is done, just imagine an innocent man spending time in jail for a false claim? ANd if the scheduling of hearing is not done properly, an innocent man can stay in jail for a very long time!

She should serve four years; the same as the men could have done...six years for perverting the course of law and then some for being a lying sick moo and actually ruining a real victims claim of rape.

No sympathy for her at all.

This is the third case of this exact nature that I have read about in the UK press in as many weeks - I am pleased to report that in the other 2 cases, the law was a good deal more exacting than the judiciary in Merthyr. Pretty low crime all things considered - Im sure that all 3 "ladies" will get a warm welcome in Holloway from the more experienced lags ................
