Need advise on car accident....

My husband had a car accident last week when a guy in a land cruiser hit him at the back.  They went to the traffic department to get a police report and we found out that he has no insurance.  The guy who hit us told us to wait for a few days and promised that he will call us. It took us 8 days of follow ups before he finally showed up and took us to a garage which is not really a garage but a scrapyard of car spare parts.

Before we went to the area, the guy told us he doesn't have money and told us to bring our car to the garage and he will pay when he has money. Naturally, we didn't agree to bring our car inside.  We went to our insurance company (we have full insurance coverage) who told us to file a case and they will repair our car then they will take it from there.

Which brought us back to the traffic police. When we requested for a case to be filed, asked us to meet with the other guy. In the end, the police refused to file a case and just told us to bring our car to the other guys garage (scrapyard).

We need advise on our options. Please help us...

As i understand, there are different procedures. One is obviously to proceed with case, accusing of the one who hit you. it may take longer and may not be easy. another option would be to file a complaint as if your car was hit and you dont know who hit you. like for example your car was parked somwhere and when you came back you saw the damage and dont know who hit you. if you take that route you may still manage to get insurance from your insuring company, as you have a comprehensive insurance. You will need to speak to the police dept regarding how to file a police report in this fashion.

anyways i will advise you to go to police dept wid someone who knows the game and speaks arabic.

We don't want anything from the other guy. We just want our car fixed, plain and simple.  It's so disappointing that innocent people get taken advantage of by people who doesn't care... And to think, if ever we finally get the justice we really deserve, we have to rent a car at our own expense while waiting for our car fixed.... grrrr!

Anonymous,  you do not need wasta at the police station, (Ya, it helps) but in my case, the guy that hit my car insisted that it was his fault but the cop was insistant on putting the blame on me. 

The captian at the police station and the local (that hit me) were good guys and got me my right.  Even after getting the police letter to repair my car at the locals insurance expense, the police guy wanted to change it.

The same thing happened in wakra to my friend two weeks before. My friend having saloon car and other side Company bus without insurance. My friend is hanging police is not doing anything againt that company bus.

I dont know such case what to advice.... One more thing

Before a week of ramadan start one of big TATA bus hit my SUV at a round about from back side.Still my car work at garrage is going on and on. No Status responce from insurance & garage, I have full insurance. I am fed with this Trafic/Insurance rule, the right driver is suffering more and more. I dont know how long such things will happen. who is correct person to Help us....

I would recommend you meet the senior most person at the traffic department and put your case there also speak to the manager of your insurance firm.

On your own, you have no chance.  I had a similar experience many times and  even though you are on the right, the police here will not take much action against the local.  Saying that, I have had justice done when senior officials came in and checked the accident report.
