Religiously speaking…. Lawyers do what they have to do to win a case. Even if it means, verbally abusing a person on trial. It’s the same thing when you work as a sales representative; you will go as far as telling everything or adding information which is not present on your product just to get that sale. What can I say..? Your commission depends on it! So as to put it “it goes with the job.

----> judging "all" lawyers through the conduct of "some" people is regarded as bias, crookedness, and inclination towards untruthfulness and whims, since this judgement considers the blemishes and neglect all that is shining and glittering.

NOT like in our religion, lying (telling false info) is totally forbidden and regarded as sin. even though there are 2 types on sins in our religion: major and minor. BUT even then, our religion does emphasize its ummah to "NOT TO TAKE THE MINOR SINS LIGHTLY" as our beloved prophet muhammad (pbuh) said:

"Beware of the minor sins which are often thought as insignificant, for they are like a group of people who stopped in the bottom of a valley. One of them brought a piece of wood, and another brought the same, until they had gathered enough to cook their food. These minor sins, if a person is called to account for them, will destroy him”.

According to another report, He said:

“Beware of minor sins, for they will pile up until they destroy a person”. (Reported by Ahmad: saheeh al-jami, 2686-2687).

Really I don’t want to carry this argumentation (but I rather called it as ‘religion discussion’) into extreme, because I am sacred you will think that as if I am trying to find a ‘defect’ in your religion. And as I said, in this discussion, I am NOT here to win, but to reveal the truth of our religion by providing “proof and evidences”. NOT by “trying to find the defects of one religion so that the other religion may seems appear to be glittering and shinning in the end!”.

Let me emphasize back, what our beloved prophet has said:

“When you are debating (discussing) about something, the intention of the debate should be seeking for the truth, NOT for winning”. (I think, by now you should have understood this statement, and NOT trying to make another kind of perversion again on it!)

I am not angry with you, and I respect your superb thoughts and opinions. It’s just my heart burn when you manipulated the quotation of our beloved prophet, and “confidently” thought that you have made a “right conclusion” based on your FALSE thought! What you said and did could distort the image of our prophet and religion (if I was not given a chance to speak of the truth!). Not believing Allah the almighty is one thing! But attack against our beloved prophet (in any ways: direct/indirect) is just like attacking the whole ummah (muslims)!

If it was just your “doubt” of our religion, then I could have tolerate with you, for our religion does encourage its ummah to have doubt, and NOT to accept everything with blind imitation because it can lead to astray. Having ‘doubt’ may build a felling of wanting to seek for answers that may convey them to the truth in the end. There are many cases in which the Non-believers had doubt in their heart- then, seek for answers- when they discovered the truth, they embraced islam. But had you ‘really have doubt’ in the first place , you would have asked for further explanations from me before making that firm FALSE conclusion, (As how I had doubted your verses of holy book, then asking for further explanations from you).

ethics of argumentation in islam:

1)argument should focus on its subject matter, NOT the person involved in the argument.

2)Argumentation should stick firmly to morality and good manners.

3)Argumentation should be concluded with peace NOT enmity and hostility.

“it is those who believe not in the ‘ayat’ (proofs, evidences, verses, lessons, signs revelations, etc) of Allah, who FABRICATE FALSEHOOD, and it is they who are LIARS” (Quran 16: 105)

“and grievous is the chastisements they (incur), because they lied to (themselves)” (Quran 2:10)

“woe to every sinful liars” (Quran 45:7)

“….and shun the word that is false.” (Quran 22:30)

Umm Kalthum the daughter of ‘Uqba reported that Allah messenger (pbuh) said:

“a great liars are not the one who makes peace between the people by inventing good information of saying what is good.” (Bukhari and Muslim)

in a muslim’s version she added: “I had not heard him i.e. prophet (pbuh) giving license for anything people say falsely except in three matters: war, making peace between people, and what a man says to his wife and her wife says to her husband”.

Bahz Ibn hakin, on his father’s authority, said that his grandfather reported Allah’s messenger (pbuh) as saying:

“woe be to him who tells things, speaking falsely, to make the people laugh, woe to him! Woe to him!”

Some of the major tribulations of human existence are the consequences of committing sins and spreading the evil into the world. According to the moral scale of islam, it is known that men is imperfect and fallible and prone to committing to sins. This is part of his innate weak nature as a finite limited creature. HOWEVER, “it is a sin” if he has the ways and means to attain relative moral perfection and deliberately chooses not to seek it.

To cut things short, i enjoy this discussion talk with you, and I hope we may get some knowledge on it, because you gave me some knowledge about your religion. And our religion does emphasized its ummah (people) to respect the religion of others, even though we don’t adopt them, for we give freedom in religion, as we believe ‘let there be no compulsion in religion’. I respect your religion and I’m hoping for you to be the same too. Your religion is your religion; my religion is my religion, for you have your own belief as I adhere firmly to my own true belief.

Let me end this fruitful religion discussion with a quotation of our beloved prophet Muhammad (pbuh):

“Truthfulness leads to righteous and righteous leads to paradise. A man speaks the truth and makes truth his object until he is written as eminently truthful. Falsehood leads to wickedness and wickedness leads to hell-fire, and a man speaks falsehood and makes falsehood his object until he is written as a great liar.” (Bukhari and Muslim).

regardless its perjury, bluffing, misleading...etc, but the root is one- TONGUE!

-----> in our religion, there is no such things as venial or mortal sins of lying. because laying is forbidden and sinful, and what sin is sin! however, according to our prophet, "anything (any info) that is 'not true' is regarded as lie, except in 3 matters":

1) War

2) when we want to breed a good relationship among the two contention. (eg: when 2 families are fighting, so we may act as a middle person to say the good things to both sides, so that it may overcome their hatred.... and the motif is not to lie, but to "breed a good outcome" / or to joint back the family... infect, it is not called as lie at all for it is already being excluded from lie.

3) what a husband say to his wife and what the wife says to his husband (especially in poligamy).

PS: in this 3 situation, it is not consider as a lie, because the motif is to reach for the "better outcome". in our religion, one of the aspects that we really pay a great attention is our "intention", as prophet said: "in everything you do, the most important thing is you "intention".- it means, in everything we do (in a legal way), it should goes parallel with good intention, only then God will be pleased by what we do.

those 3 matters are excluded from lie, not done just for the sake of fun! but this is the tolerance in islam. there is a high level of tolerance in islam for the "ease of their ummah" (people) and what may "suit with the situation".

what i meant to maxi was, i did studied law, BUT i dont use it to make perversion and lie to people as what most lawyers and judgers do, i ONLY use it for the sake of seeking the thruth or revealing the truth.

Perjury, Bluffing, Misleading, lying by omission, white lie, emergency lie, and so on.

Lets make it simple:

Thomas Aquinas divided lies into three kinds: the useful, the humorous and the malicious. All are sinful according to Aquinas. Humorous and useful lies, however, are venial sins. Malicious lies are mortal sins.

I beg to disagree...

Lying to kids would maake the truth harder to tell. I know, because my MOTHER LIED to us about our FATHER being a good husband and father...oppps, father made mistakes that was to palpable to ignore. Remember, kids are very keen about the things around them.

I never hid the fact from my daughter that me and her father would never be together and she was 4 years old then. I told her as if I'm telling her a story... I knew it will hurt her but she needs to know the truth.16 years later, she's still the same wise and sensible child.

well, a lie is a lie..white or not, harmless or not...

there are instances where lying is the better option because the truth will just make things worse...so if u have to fabricate a little or maybe a bit more, i guess its acceptable...sometimes it is better to just say what people wants to hear, u r fooling them in some ways, misleading them, but sometimes it is better for them that way than knowing the truth...eventually the truth will come out but there is the hope that things would be better at that time and that the person would be able to accept it by then...just try to be more convincing when lying, its so irritating when people try to convince u of something that they themselves dont believe in...

yeah maxi, i agree with you. if we take that concept of "lie to not hurting"...there will be often a side effect for that.

but i am not encouraging people to lie, nor do i like to lie to people, because once we lie, we need to carry lieing throught the time. in parallel, we are carrying the sin too.

however, there are times when we have to lie but for the good intention. but i think, the concept of "lie to not hurting" cannot be implied to all circumstancial. we need to consider first the pros and cons in the outcomes for doing so.

for eg:

if telling a man that his son is having an accident, can cause this men to have heart attack and die...then i prefer not to tell it to him. (yeah, its better to lie than to "kill' someone...hehehe...even if one day he discover the truth, then got shock and die,....at least i am innocent, for thats how thing goes, it wasnt plan by me at all...... mmmwwahahah....*evil laugh*)

but:

as you said above, if the men is perhaps having a cancer and waiting to leave the world, (if i were the doctor) i would rather prefer to reveal the truth to his wife and chidren. because no point for me to lie. i lie or i dont lie, the situation is still the same-"he is dying"!

so above all, the concept of "lieing to not hurting" is very fluid to me. it depend more on the circumstancial, and measuring the pros and cons of doing it. because when we are in between of truth and lies, its sometimes hard for us to decide which one to choose.

if i cant control the situation as what happen in the second example, then i have to reveal the truth for it is beyond my hand. but if i think, through lieing could control for the good of the situation, then i prefer to lie. actually my intention was not laying, but to reach for the good one (Thumbs up)-had i given another option, then i wouldnt choose to lie. (see maxi, how houri is trying to defend herself here......hehehe.... but really maxi, i am serious...hehehe)

Why do some resort to white lies or lying (per se) instead of telling the truth?

My opinion:

1. Truth hurts... as always; they saw, "what you don't know won't hurt you, so to speak.

2. They don't want to other person get upset/angry or disappointed.

I know what you're getting at...nobody wants to be lied to. It's much better to spill it out but most is afraid of the reaction or outcome of them telling the truth.
