One of my friend working in Qatar , his manager is a local Qatari ( He is having a good relationship with labor officers and do not care about Qatar Labour Rules , He say Labor rules are kalliwalli ) 

He was working for the same company for  last 7 years.

From the last vecation (2012) he took more than 10 days from his allowed annual leave , then when he return , they forced him to sign a new contract which starts from (2013) .also they reduced 1 day payment from his salary ( for 1 month ) .

The problem started when he applied for Resignation ( 3 months ago ).

Now they took away all his 6 years end of service benefits and they decided to give him only 1 year end of service benefits

Now what he can do in this situation ?

How do you think about complaining at Qatar Human Rights Department ?

How many days may be he have to stay ?

Who will pay for the expenses for the extra stay for untill the problems are solved ?

Can he stay company accomodation during this duration ?

What are the chances if the sponcer can give a fake cheating case against him ? . 

Especially there is any use approching Qatar Human Rights Department ? 

 

Please Help him ,he is afraid to approch Labour Department , because none take them seriously .

My friend didn't approach labour department , He left company without taking his end of services .

It seems No one trusts labour departments here .

CHAPTER 4 - END OF SERVICE COMPENSATION

Section 24:

1) In addition to any amount due to the worker at the end of his service, the employer must pay the worker an end of service compensation (reward) for the duration in accordance with this Act, after working for at least one year.

This compensation is calculated as follows:

a) The base wage of the worker plus a cost of living allowance, if any, of three weeks for each year of the first five years of continuous service.

b) The base wage plus a cost of living allowance, if any, of four weeks for each year of service of the second five years of continuous service.

c) The base wage plus a cost of living allowance, if any, of five weeks for each year of the next following ten years of continuous service.

d) The base wage plus a cost of living allowance, if any, of six weeks for each year of service which exceeds twenty years of continuous service.

2) After the first year of continuous service, the worker shall be entitled to a compensation of the fraction of the year thereafter in which he served.

3) If the employer terminated the worker from his job after 1 month of continuous service, under conditions other than those stated in section 20 above, and then reinstated the worker in his job within two months after terminating his employment, the employer must consider the worker's service as continuous and uninterrupted with regard to the application of the provisions of this Act. *

If he files a complaint he will have to stay at his own expense. It could be months if not more. I know, it ain't right, but there it is.

Pls try to approach labour dept. To complain about the

Labour abuse in the company. The new contract, which is signed by the employee, its because of he stayed more than approved leave is not justified to make new cntract, if it is right, every employer can do it

But, its illegal as per the labour dept.

all your question above cant be answered. its all depending on the situation. some of the questions can be answered by his "sponsor".

complaining in human rights dept is good idea (but duration of the verdict cant be said). since he is in this country (his passport and ID are the proof) the company cant deny that he is working with them for the last 7 years. good luck for your friend :)

I asked him about that , His company never provide copies of the agreement to him or any of their employees .

Is it possible to get a copy directly from Labor Department ?

Once he having previous agreement with certify with labor department .........mean no problem
