Question about resigning

Hello guys !
I am curently employed in one of the state companies in Qatar. I am planning to leave this company, but there are some problems.
Lately, my company started charging money to my colleagues that have resigned, stating that they ( the employees ) have to pay for:
- the recruiting agency`s fee
- the plane ticket from their countries to Qatar
- the fees for the medical exams for the RP
Now, the only problem is that in our contracts are stated the following:
- "6. Airtickets.
...the First Party ( employer ) will be responsible :
a. To provide air tickets for the Second Party ( employee ) on his first arrival in Doha and upon his final departure.
b. The annual vacation air tickets once every two years..."
- "17. Contract Termination
(a) Either Party may terminate this Employment Contract by providing in writing one ( 1 ) month notice.
(b) In the case of termination of the Contract by either Party during the Contract, the Second Party is entitled to bonus according to art. (8)"
*art. (8) reffers to the End of Service Gratuity.
- The most important thing is that THERE IS NOWHERE IN THE CONTRACTED STATED THAT I WILL HAVE TO PAY SOMETHING WHEN I AM LEAVING.
The company`s main reason was that everywhere in the Middle East you have to pay. I agree with that, but at the same time everywhere in the ME IT IS STATED IN THE CONTRACT this thing.
Considering the fact that it`s written in my contract that they will provide me with the first plane ticket, and that there is no mention about wheter I have to pay something or not upon resignation, I feel that they are not entitled to make such demands.
What do you say ?

If you work in your home country and don't like the job after you have started, it's not such a big issue. However, to mobilise a guy to the Middle East is very expensive and unfortunately some guys get homesick or find the heat too intolerable. Having been in the position of hiring guys myself that have only lasted 1-2 months, I think companies are well within their rights to deduct mobilisation costs from an employee that doesn't honour his contract. If I were Qatar Kentz, I'd have done the same thing. Also, some guys accept any job in Qatar so they can look for better opportunities while they are here. Then they are annoyed that the company that paid a fortune to mobilise them, won't give then an NOC. Come on guys, get real. Play fair and expect to be treated fairly.

to the labor law of Qatar! Or you can ask an opinion from the authorities there at the labor or human rights office.

@ flor: I do not have such clauses in my contract. The only thing is that I have to give them one month notice. Except for this, it is nothing written there about paying anything to them when I resign.

@ Zmanz: I do not care about the NOC, as I do not wish to stay here for the next couple of years. Did your friend signed something where those deductiones where mentioned ?

A few companies has made it a policy that if you leave by your own by resigning then you need to pay the recruitment charges and also the air ticket

one of my friend had the same experience with Qatar Kentz company. they deducted the amount and also denied to give the NOC to him.

the receding of the contract, usually the company will charge you proportionally of the expenses they incurred in recruiting you. If your contract says two years, then they will charge you 50 % since you past your first year.

But check the details of your contract about resigning or termination clause of your contract and check if it complies with provisions of the labor code of Qatar!!

I just paased my 1st (out of 2 yrs) year of contract, 2 days ago.

Sorry, I forgot to specify this earlier.

They have hired me from my country.

I am very interested about the money, especially because it is not stated in the contract that I will pay something to them.

how long you have been working with them? if you finish your 1 year or 2 years contract with them, then maybe you can ask them about your airfare if you did not fly to your home country yet...

End of the day you have to be with it as mention in your contract, if you are less then the time frame.

so 1st let us know how long you have been with them and if they hire you from Qatar or from your country, then its will help to reply you back ,,,
