im working in a private firm in one of the divisions,
My employer is planning to shut down the division which i'm working in for the past 15 months, (fyi my contract period is two year's and place of work is Qatar).
and they have given me only one choice which is to move into Saudi office or else go home.
Since i'm not interested to work in Saudi. i requested them to provide me release or NOC so that i can join to a new job (which i have one better offer lined up) in Qatar itself
they are not willing to provide me either NOC or release of visa.
i hope this is totally against justice and i believe i am eligible to get either NOC or release

can anyone provide me a solution, am in a right position
to consult the labour court

Don't waste your money on a lawyer. You have no right to demand or expect an NOC.

Either go to Saudi, or leave Qatar. There is no third choice.

appreciate the comments and thanks for the concern a bit disappointed though reading all these , so the thing is that they are not actually shutting down the whole company , they are just shutting down our divisions operations in qatar, and the only choice ive got is to move to saudi into the same inhuman company as shabs said, i dont think i can bear them in saudi after all these bullshits i went through.

anyways im gonna go to a lawyer regarding this issue.

seriously qatar gotts to learn from dubai a loot !!

If the Company is closed then where is Sponsor Power. Here sponsor is finished why he want to finish all. There should be a law if the company is closed for a reason what so ever the employees of that co. should have freedom to join other company because Govt. knows that the present Co of the Employee is Closed. So why everyone want to Screw employee here. Is there no Good Law for the Employee.

THE BEST WAY IS TO ASK FULL SALARY OF CONTRACTUAL PERIOD IN LABOUR COURT AND OUTSIDE SETTLEMENT WILL BE noc AGAINST THE PRESENT OFFER LETTER :) HOW IS THE IDEA FRIENDS:)

Sorry man, there is no eligibility for NOC/Release for anyone. It is up to the Sponsor. Try to get it diplomatically or leave for 2 years to come back if you think that you can work only in Qatar.

hi!

labour court nothing to do any thing in NOC or transfer of visa. labour court only deals with your settlement issues with company.

moreover you still not completed your first contract with your co. ie 2 years as you mentioned.

NOC can be obtained at any time but it completely depends on your co.

Transfer can be done after completion of atleast 01 year if, you are on transferable visa. and you can ask for the first time after completion of your first contract period mentioned in your contract agreement it may be 01,02,03 & 05 years.depending upon co. in qatar.

in your case you can do only humble request to co. that they can release you on humanitarian ground which few co. doing here in qatar.

best luck!

I understand your situation. This is one of the talked about issues for expatriates like us. And this is one of the main reasons why informal Visa Businesses flourish in Qatar. QAR10k to 17 or 18k for one visa is the normal rate what i hear.

In your case, the only solution what i suggest is to move back to your native place for 2yrs, gain experience and return back to Doha on visit or purchasing a Visa. Moving to Saudi under the same inhuman management will only make things worse.

A complaint can be filed on the basis on the contract, but the contract will remain void, once the CR of the company closes, hence the case will be dismissed.

I hope my answer could be of some help.

Best Regards

Shabir Hameed

there is no law which talk about NOC, its all depends on ur sponsor either to give or nt, all u have to do is to discuss the matter with ur company n have a solution otherwise nothing can help u.
