My employer refuse to accept my resignation

Hi everyone! I am working here in Qatar for more than 2 years as a project secretary in a construction company. Last August I received a job offer in UAE and I accepted it, after that I tender my 30 days notice resignation letter to my employer but my general manager refuse to accept it and he offer me salary increase but I refuse the offer because I consider the company in UAE is very big company compare my current company here. My GM told me that he will not allow me to leave the company because he has no qualified replacement in my post. My contract duration is UNLIMITED. I'll bring this matter to the ministry of labor to file a case against my employer and I will stop work after the 30 days notice, is it against labor law to stop work? How long it would take from ministry of Labor to decide in this matter? because the company in UAE expecting me soon because the work there is urgent. PLEASE ADVICE. THANKS!

I submitted my resignation last sept 18 and informed them that my last day will be oct 20, last night sept 24 my boss told me that he will approved my resignation but I need to wait until I have my replacement but did not mention any date when will be that time.. I knew my boss very well and I know that he had the purpose of delaying my leave, as per qatar law the company can delay my leave for 2 weeks upon termination of contract.can I stop my work on oct 20 as per my notice period?worst case if i bring the matter to court if he still dont give my clearance after 2 weeks of the contract termination how long will it take the court to decide on the matter?thanks...advice please...

Hi, alsboy is right. If he doesn't have any alternate employee instead of you, then make a demand. State "If you want me to stay here, then give me this much salary, tell him how much you are going to get in UAE (Tell him a bit more than you will actually get), and then ask him for a good salary. He then has only 2 options.

1- Go according to your demand

2- Fire or let you go, then you'll get the job in UAE.

Dont u c the chance??? He doesnt have anyone else who can replace u, so use up de chance (Comes not quite often). Its time 4 u 2 place ur demands across and i am sure u can go a long wit demands... So start making a list and show it 2 de GM and say "If u wanna me 2 stay, thts wot it wud take u 2 keep me here". Simple, aint it...

Go on urgent leave ! tell them some1 is sick in ur family (may God forbidd) and bye bye! but then u will lose all ur end of serive money!

or just go to the labor of work and ... oufps! long story! goodluck.

I submit it first to my immediate superior which is my Project manager, he acknowledge by writing in my letter by endorsing it to our GM for advice and I sent it fax to our main office. I have copy of received fax confirmation report.

1. Ensure you have a copy of your letter of resignation with you.

2. Your 30 days notice period as per your contract is validated whether your contract is open or for a set duration.

3. Your employer has no right to keep you working beyond the agreed upon resignation period.

4. Issue a letter in good faith to your employer based on his verbal decline of your resignation and respectfully remind him that the contract agreed and signed between you both clearly indicates a 30 day resignation period. As a result, thank him for your tenure at the company however do state that your last day shall be x day and that you would appreciate receiving all your entitlements as per contract etc....gratuity, final settlement etc..

If the employer is still proving tough to give you your rights, then a trip to the labour dept will be required I am afraid......

One always tries to avoid the final course of action to avoid drama but you may be compelled to take this route if your employer fails to deliver your legal rights.
