Problem in my contract....Kabayan here!
Help me please. I am here in Manila and is about to sign a contract for a job in Qatar but my recruitment agency told me they will let me use a different employer/sponsor in my employment contract (totally not the same company that I will be working with when I get there in Doha). According to my agency they have no papers (job order) to process me under the company that will hire me but instead they will use papers from a different company to be able to process my work visa and this is just all for documentation only. I was also informed that upon arrival to Doha, there will be no problem and definitely I will be working with the real company which hired me and not for the sponsor/company in my contract.
But, I am still confused with that scenario. Can you give me insights on what are the possible complications and consequences if I agree of signing the contract under different sponsor?

i emailed the company that is supposed to hire me regarding the reason why they can't provide papers for my processing but no replies from them...i am wondering they might not be able to produce honest answers to my questions...

if you feel theres something WRONG with it, it definitely IT IS! Why take the risk.
There are a lot of horror stories to our kabayans here, do some more research. Possible complications will be, since you signed a contract for a different company they may have the rights hold you down and will not let you work to the company that you applied for. Another complications is, when this happens you might be working different jobs other than being a secretary.

not unless they are of the same group of companies.... maybe there is no filipino visa in that particular company but their sister company have.....
but it is still risky coz from time to time the government are inspecting offices esp that your work is a secretary, ur a frontliner, your iqama will be the first one to be checked....

are you directly hired by the company here in qatar? or the agency gave you this job?

Contract should come from the company who hired you. if they issued working visa you have to go thru agency and pay placemnt fee. agency's job is to have it translated for you and some sort of things in POEA. if you were hired by the agency and they told you they dont have job order so you will signed contract under different employer. i think you should ask in POEA for more info.

i agree with aling tatess...there is a law in qatar that says, you will be punished appropriately (jailed and/or penalize)if you were caught working in a company which is not your sponsor. and there are random inspection being done now a days by the authorities. i knew an incident, wherein a supposed to be sales lady who was working not under the sponsorship of the said shop was caught by a civilian authority. she was penalized and asked to pay 26,000 QAR, and to think that her documents are under process for transfer of sponsorship to the said shop.....isip kang mabuti, sir.. di ka naman namin mabibisita kung nakakulong ka na..sir, yung sales lady ang nagbayad nun.
thanks for all your replies...I thought no one will give any insights about my problem...by the way, if I found out that these two companies are related or sister companies, does it mean my contract will be legal even if I am under the sponsorship of the other?

up to validity date .i am not sure if it is valid for 6 months only or 1 year. better ask the hospital and depends also on the new agency if it is okay with them.
im a bit concern about your situation and reminded me of how anxious i am when i was in your position 2 years ago. so i'll try to help out as much as i can and try to remember the things i did to verify if my contract was legal or not.
1.) find a contact person in your sponsor here in qatar either you call them or e-mail them. i found mine through yahoo and google and luckily it was a pinay.
2.) Do not sign that waiver yet.
3.) check your agency in the Philippines if they are accredited by the POEA.
4.) i've dug up my old employment contract and this is what it looks like:
- the employment contract has the letter head of your sponsor on top.
- half of the paper is written in english. half is in arabic.
- the "Employer" is your SPONSOR.
- the "Agency" is the agency back there.
- i also see a stamp from the philippine embassy here in doha on every page.
- stamp from the labour attache at the final page.
5.) my arrangement was a visa on arrival. and the visa type is: work visa.
i'll try to remember more if i can and hopefully this info will help you decide wisely and trust me my friend, you dont wanna mess up with the laws here. cheers.

A great friendship is not great if it can be injured by a little dispute...
yeah, that is for their own advantage not yours. they were trying to play safe just in case worst comes to worst and you won't get any help from them(especially monetary) in the end.
Now, I am worried because I had already taken my medical exam yesterday but still awaiting for the results..should I turn down the agency's terms of processing my contract, can I still use my medical results (provided I am fit to work) to apply for another agency here in Manila? How can I do that?
My agency also wants me to sign a waiver which will prove that I agreed to sign my contract under different sponsor.
do you have any idea how much money you are going to pay out of that penalty? huge as in huge amount of money!
your contract should be under the sponsors name and not with other company that you are not supposed to work with.

What do you think is the reason behind this why the real company that hires me doesn't or can't produce papers to legally hire me under their name and needs to have agreement over a different sponsor/company to be able to process my application instead?

I want to take the risk but also I am afraid being penalized for this act when I get in Qatar. Is this really being practised there in Qatar?
under a company not your sponsor. You will be sent to jail once caught and will pay penalty for that.
