Gratuity or End of Service Benefits

Hi everybody, just wanted to ask or to know some ideas about my situation, I worked in a locally based consulting firm which compose of supervising high rise buildings, roads, means a Class A consulting firm dealing with design and consultancy for 5 years. Last year January 2009 while working in my office i recieve a letter from the HR stating that tomorrow i will be no longer connected to them which means four of us from the design department and 12 members from site (engineers) were terminated that day.(without even notice of terminitaion) I was so shock that it was my last day working in this consulting firm whom i serve for almost 5 years. but i have nothing to do but to accept that letter which they forced me to signed and recieve it. so in that case i dont know what to do cried while walking to my room i think of my children what will be their future our future if its like this. I couldn't beleive that inspite of working for so long that will be the price i could get is a "termination letter". i couldn't beleive because there are some foriegn engineers who's new comer in our office and they keep on telling us that due to economic crisis they decided to reduce manpower because of no project at all... so in this case and as far sa i know it would be FIRST COME LAST OUT RULE but anyway to make it short most of my colleagues send back home and 4 of us got release from our sponsor because of what? (we have bank loans. and till today whenever i called them to ask about our end of service gratuity they keep on saying that they're not giving gratuity because that is the company rule.
My question is do the private companys here have the right to have their own labor law inspite of contract that we have signed and stamped by Qatar labour office? are those labour contract we signed be follows? and
do i still have chances to take my end of service benifits?
maybe some of you may have ideas about this.. I need some information. thank you...

Gratutity has nothing to do with your contract. The law of the land over rules all the contracts. You are eligible.

I work with the company from 1997 todate, i resign and going this july. how much should i get End of service pay if;

a. 1997 contract is silent about end of service pay (it does not say anything about it).

b. in 2004 i need to process visa for my child, in that day i need a contract so the company did provide me a contract with date back of joining to 1997, which says that gratuity "WILL BE PAID". these document was signed and stamped by labor dept. in 2004.

c. again in 2006, same thing is required for another child, but these time gratuity "AS PER QATAR LABOR LAW"

the company says end of service pay only start on 2005/1/1, thus i got only from 2005. is these correct.

your input/comments is or will be highly appreciated.

Normally, termination after the probationary period (which clearly u passed after 5 years)should be both agreed by both parties through notice period. If your company terminated your employment before the end of your contract and without notice period, u can file a lawsuit for damages & failure to pay the required end of service benefits. Companies may also be obligated to compensate the employee for an amount equivalent to the wage for the notice period.

temper is something u cant get rid of... by loosing it...

If you ready to fight with your company you can file a case in Labour dept and 100% you will get end of service and notice pay. (depends on contract), once you completed your probationary period they have to give you one month notice or notice pay. What is your specialization in Engineering send me your CV as well to [email protected], I am working in a Project Management company let me see, but not assuring.

Im sorry to hear about your story. But as far as Qatar Labour law you have the right to claim the end of service gratuity especially if its stated with your contract you the contract. The good things is you have secured the NOC from them now you can find any job around atleast. You can seek advice from the labour in Industrial area.. If they Labour arbitrator cant arrange the payment in labour the case will goes to court which will take time to process unless if you are really eager to get you will have it. They cannot escape the law.
