Advise on termination and transfer
I got terminated, due to economic reasons from my company after my annual leave. I received a termination letter where as they promise they will do the transfer of my RP and give a release. About 1 month after they call me and offer me my job back and said they made a mistake, I received a offer letter, but didn't sign anything. I then send them an email and rejected the offer. After that they seem to be funny and don't respond to my request on transferring my RP to the new company. NO reply to my calls or emails. And I am still on there visa just need to transfer to new company as mentioned in the termination letter. Can anyone please advise what I should do and can I fight this matter with the termination letter? It's just way unprofessional to terminate someone and then offer them the job back after a month. Am really sorry to hear about your case. While I agree that it is highly unethical and unprofessional for someone to handle your case in this regard, nonetheless it still keeps happening in companies from time to time.
You can speak to the HR department and insist on your transfer which they should do legally ( if u r a local hire). If they do not want to give you a release, it has happened in many cases in many companies. You will definitely need to follow up as the company could portray ur refusal to sign the offer as a reason to cancel ur RP.
Worst case, u can go to labor department and complain.
YES you can fight and can file a case in labour court,
Sure they have to give you NOC as they mention in your termination letter.
