Road Accident -- Please Help

I had an accident while waiting at the traffic light and someone hit my Armada from rear. The damages are around 40K or maybe more. The police report says the other guy was at fault but he has expired insurance. He asked me to take the vehicle to his garage and he will get it fixed, I refused the offer simply because I did not trust him. I have full insurance the company says that I have to file a case in court and only then they will fix my car. Its been 3-4 weeks now because the person who hit my car insisted that I don't take the matter to court and he will pay me some cash. He wanted a week time and finally came back saying that he did not get a loan. I finally requested the police to put a case forward in court as we are getting anywhere. Will I need to go to court? People are telling me that only persons at fault are called in for hearing. Will me insurance pay for the damages? I have lots of unknowns. Any advise?

I was once hit from behind at a round-about,last May 2010, the car booth was a wreck.

The only paper I provided to our admin was the police report. They managed to claim under the insurance and get my service car fully repaired in ten days...

What everybody is suggesting that your insurance company should handle the case and police report should be sufficient. Your insurance company should handle the case. This is normally done through most of the insurance company. Looks like it is not your situation and you insurance company is asking you more. Consult with your insurance company and get the detail what is expected from you and what is expected from them. I guess you have no choice but to follow the instruction from your company (which is not the normal case)

BTW what is your insurance company name?

You need to find a lawyer experienced in traffic disputes to get good legal advice on your options, it may cost you a little extra but it will save you a lot of stress, lost time and embarrassment, especially if the lawyer has to get your insurance company to step up to their responsibilities.

QL is a good forum but 90% of the time the advises given by other members is either silly or simply illiterate.

There should be a punishment to the driver who drove a car without any valid insurance, especially the driver is reckless, authority should do something.

I am not been given complete info by anyone so far, I mean the police, insurance, the guy who hit the car, and others.....Not sure what is my next step. My vehicle is not driveable since the accident (3-4 weeks) and I am paying for the rental, repair estimates, tow trucks, etc. and I am NOT even at fault. I was sinply waiting at a traffic light the careless driver hit us who already has a record of speeding fines (unpaid) and no insurance.

the insurance to do their job. If your insurance coverage is comprehensive, it should be the procedure. If they are telling you to file a case first, then you have a very bad insurance provider!
