Pregnant and Terminated from work
I was one of the staff who receive a demobilization letter effective 1 month from now. This is a move by the company since the project is about to finish. However, I am already 8 months pregnant and due to give birth by November 2011. I've searched through the Labor law and it only says regarding the maternity leave. My question is: Can the company demob me while I'm already on my 8th month? Others are saying that it is illegal but I have no basis for this and like I said, I cannot find any in the stated labor law. Is the company's action to demob me valid? Or do I need to file a complaint? Although transfer of sponsorship from company to my husband is possible, I would just like to know what is my stand on this. Also if ever my visa will be cancelled, it is also impossible for me to return home to my home country since the airline might not allow me to travel. Hope someone can enlighten me regarding this. many thanks!
Hi
if u can transfer you r sponser ship to your husband do it
cause the law is clear that they can terminate u unless u are on sick leave or vacation ... etc
but your condation is not included unless the termanation was given on the base that you are pregnant ,
any way the saf mode for you is to transfer sponser ship since they allow u
u can file a case and have birth her it is only 2 month but maybe later u cant force them to give u relace
I think it will be better to transfer your Sponsorship to your husband to enable you to stay here and find another job later rather than creating an issue with the Company which might close the door to get the required NOC. If you have enough evidence to prove that the termination is due to your pregnancy and can go back to your country and wait for your husband to get a family visa for you then you can think of approaching the Labour Court.
However, you should consult a legal advisor before taking any stern decision.
Under normal labour laws in other countries, you definitely can sue them for terminating you while pregnant and you can make the case that they fired you because you are pregnant. From working abroad for many years, I know that companies dread firing a pregnant woman for those reasons exactly. They think ten times before taking such a decision, because they can see the law suite coming,...Not sure about the Qatari law though,... It is best to call on a lawyer specialized in these matters,...
@ s_sale...
they did not say exactly that they are demobilizing me because I'm pregnant. Their reason is that the project will soon finish and there is less work esp. my scope of work (they don't need my services anymore). But on my opinion, maybe company is also trying to save costs so that they don't have to pay for my maternity leave, etc. And I just heard that I am one of those staff receiving good pay from the company. So just think how much the company will save if I end my work with them. Hahaha...Well, this is just my thinking....
you can let them cancel your visa and come back with family visa
were you demobilized because you were pregnant?
