"Transferring of Sponsorship"

I'm a bit confused here and need some help from you guys. I was sponsored by this company for 5 years now and they allow me to work in another company. I haven't transferred my visa ever since I came / work here. Now, I'm currently working in an engineering company for almost 2 years now. But the company who sponsored me will be closed this end of December and for the first time they need to transfer my sponsorship immediately to my current engineering company. I already told my engineering company my situation and they give me a copy of the offer letter to give to my sponsored company so that he will give me NOC.

The question is: Do they (engineering company)need to have an "available visa" for me to "transfer my sponsorship" to them?

Yes they need an available visa beforehand. Depending on nationality it could take 3 days or it could be refused by MOI.

I just got my RP renewed 2 days ago. My engineering company keep on insisting that they need a visa. But I already told them that I already have a visa, all i need is the transfer of my sponsorship to them. As far as I know, they will just fill up a form and give it to immigration then they will change my sponsor in my RP.

Most probably, same case with a female co-worker of mine. Company had to get an allotment for her visa. I just don't know if its a rule or on a case-by-case basis.
