Resignation

Hello sir/Ma'am,
I am working in Doha as sales engineer for last about 1 month but now i want to go back to India becuase of some reason and i have given resignation to company,now they are asking me to pay 45 days salary that they have written in appointment letter but in qatar labour law it is not like that.they are now refusing to give my salary also .They have my degree certificate that is also not giving me.They want to trouble me.Even i dont have money for expenses.Can you suggest what to do in this condition,please help me out i want to leave the country ASAP.

Labour contract is valid ONLY IF IT IS ATTESTED BY MINISTRY OF LABOUR.

You can contact Indian Embassy with a copy of your contract, they will be able to resolve the issue at the earliest.

Go to the labour deprtment. They will help you by all means. No way they can have a contract stating that to repay 45days salary or reach your Embassy, they will help how to proceed.

I read my job offer before joining my company here, it is stated there that "In case, you wish to separate from the services of the company during probation, you should be giving us an advance notice of 90 days in writing or 90 days salary in lieu thereof" Please be aware that the company had incurred considerable expenses including,

but not limited to, recruiting the Employee, training the Employee if there is, attorney fees, travel expenses if hired from your country, visa and rp.

Sir please review your contract or the offer letter. They might state their or if not check with the labor law here. You can search it.

Dear...

As I told you before go to Indian Embassy and tell them about your situation.

There are no such laws to take cash from you if you are in probation period.

And regarding the offer what you signed, As per my knowledge it is not valid. If it is a contract attested by ministry then it is ok. But there they cant add these points of deduction of money and all.

And again, If you go to Indian Embassy they will be helping you to the maximum.

Is is right to pay 45 days Since i am in probation period ,they have mention that in the event of quiting your employementwithout notice,you shall pay to the companya sum equivelnt to 45 days Salary,in the lieu of notice period.

But just now i got call that they said today is my last day so from tomorrow no need to come to office.now what action i should take please suggest....

so you have money to pay them and money to pay your ticket. And maybe get your original papers. And good for you to know, that you are not ALONE in such situation.

you mentioned about 45 days you have to pay and it is included in your appointment letter, which i assume you accepted, and since became legal and binding.

the provision of the law is basic, any and all agreements entered by the parties if in accordance with the law is also valid.

since you only worked for the company for 1 month, which i also assume, paid for your visa and ticket to come here to Doha is entitled for a compensation based on your agreement with them.

how can you ask for salary for 30 days if you have to pay them for 45 days.. you have all the right to take all your documents back and this will be a good subject of a complaint with the Labor Department. GOODLUCK!!!

You are an educated person and how did you give your original certificates to those guys and you want to quit the job after one month? You should have well studied their offer before accepting it.

... and you should NEVER give anybody the originals of any certificate. Let them make a copy and immediately take the original back!!

Simply report the incident with your requirement to the Police or Labour ministry.

Also you can approach Indian Embassy for the issue. They can sort it even faster as they will directly call the company if you are genuine.

As per my knowledge you are on probation. So either party can terminate the service with out prior notice.
