Working Visa NOT Cancelled after 2 years

Misri Frances
By Misri Frances

Hello everyone, I have a problem with my visa. 2 years ago (NOV 2011) I left Qatar and resigned from my work. This month, (DEC 2013) a new employer applied a working visa for me, since I already finished my 2 year ban.

But apparently, the immigration denied my new employer's application for a working visa under my name. I had a gut feeling that my previous employer may have not cancelled my working visa. True enough, when I checked at the MOI site, my visa status states:

Visa Expired (Date: 2009) and below that it says: Transferred to Resident Visa.

I have no idea what happened. Isn't the system supposed to AUTOMATICALLY cancel our working visas once we leave the country? Do I need to ask my employer to cancel my visa? Do I still need an NOC?

By the way... I reviewed my contract from my previous employer, it seems that my contract is an INDEFINITE term type of contract. I have been reviewing the QATAR LABOR LAW, and I read that the working visa is tied to the duration of the visa. My employer, applied a 5 year visa for me. I don't know if this has a connection with my vworking visa not getting canceled, even after more than 2 years.

Hi i am also facing the same issue, i worked for 2 months and 10 days in qatar, before three days i am leaving from qatar only i got my visa stamping done from my sponsor.

If that stamping is done am i not eligible to go back to qatar for 2 years?

Even i dint taken any exit permit from my sponsor he said your visa has been cancelled, is their any possiblity to my sponsor to cancel my visa within 3 days?

Even when i am checking my visa status in website, it is showing that visa had been transferred to residence, what does it mean?

I left qatar before my prohibition period, so i dont think qatar ban will applicable for me, what do you say?

Please.. please help me in this regard with your valuable comments.

If you have been back in Qatar for 7 months in the last 2 years, the visa system may not have cancelled your visa, since you were here in Qatar.

I thought visas are only cancelled if you are actually out of the country for a long time.

Hi Misri. I am really confused on how you were able to check the status of your WORK VISA from your PREVIOUS EMPLOYER. As what I have mentioned a while back, that link is for checking certain types of VISA but not a WORKING VISA WHICH YOUR PREVIOUS COMPANY DID NOT CANCEL. If you have input your passport number and nationality, the result would somehow point to your RP number which is your working visa number. You need to double check the result.

You mentioned that you were able to return to Qatar after resigning from your previous employer, well that would explain the result that showed up. It could have been your visit visa which was transferred to resident visa. What happened during your visit in Qatar? Assuming that the result pertains to your visit visa, why was the result showing that you were given a resident permit (transferred to Resident Visa).

No one can use again your visa number. But it can be re-issued again with a new number to another person if the previous holder of that visa was cancelled.

Sorry about my previous post. It was incomplete.

@ da_ruru:

i did not use my visa after I left Qatar 2 years ago. based on what you said, new employees may be using my working visa, is that correct?

but the visa status shows that my visa is expired. can new new employees use an already expired visa since 2009?

@Galinda:

what a harsh to thing to say, blacklisted!

firstly, if my visa was indeed cancelled, the visa status should show CANCELLED. so its not a MAYBE. it is fact. try checking yours using this link:

http://www.moi.gov.qa/VsaWeb/Actions?action=getVisaInfoInput&language=English

Secondly, I don't think I would have been able to return to Qatar, using a family visit visa and stayed there for 7 months if I was blacklisted.

Thirdly..I'm sorry to say but you have to refrain from posting answers when your knowledge about the issue is also limited. It's not helping at all. Anyway, thanks for complicating my problem.

@ da_ru: you can check the status of your visa at the MOI site: http://www.moi.gov.qa/VsaWeb/Actions?action=getVisaInfoInput&language=English

My understanding regarding visas is limited and using that site, the only information that I see are details of my passport, and these words below: Visa Expired, Transferred to Resident

I called my previous employer and this is what they told me, the system was supposed to automatically cancel my visa 6 months after my departure. They're checking my problem with the immigration. I guess the last recourse is to get an NOC from them. Thanks anyway.

@lims_analyst. As I have mentioned, the link will work in situations like yours wherein you have been issued a work visa with an entry expiration. It is a valid work visa but without a Residence Permit. It means that a WORK VISA that have been used with a RP is not gonna get any result in that link.

@ da_ruru thanks for the information. But the link i sent it to you , it ask for passport no/visa no. and the nationality. u need to enter these 2 and will get the status. i can try it from my end but for that u need to mention ur nationality + passport no or visa no to me. u can mail me on [email protected] . Only if u want.

@lims_analyst. BTW you can check the status of a work visa if it is still unused with an entry expiration. But a VALID WORK VISA could not be checked online once it is already used.

@lims_analyst. I cannot access the link you provided. AFAIK there are only certain types of visa which you can check online. Other than that, A VALID WORK VISA could not be checked online unless you are the employer/employer representative whereas you have access on your existing company visas.

Your situation is very different from Misri Frances. You never entered Qatar and you did not use the work visa which was issued to you. Your ENTYRY VISA was automatically cancelled and due to that your WORK VISA was automatically cancelled too because the work visa that was issued to you was never used.

Therefore you are not eligable to the 2-Year Work-Ban. You are free to come to Qatar and work here anytime.

@da_ruru . u can check the status of visa online. follow this link.

enter your passport no/emp. visa no and nationality .

http://www.moi.gov.qa/VsaWeb/Actions

I was offered a job in qatar in 2012 nov and was given 5 yr work visa. But i never entered qatar within 6 months ( till april 2013) of visa issue so it got cancelled. And the status shows cancelled and visa validity expired. This means it cancelled automatically . Even though my employer told that they will cancelled the visa , but in that case this 'validity expired' options doesnt come . My question is that now my visa status is cancelled so am i free to apply again in qatar without any issue?

If you were leaving Qatar you should have just cancelled the visa before going.

Maybe it hasn't been cancelled, or maybe you've been blacklisted for leaving without cancellation.

BTW, how were you able to check the status of your working visa? I have no clue on how you were able to do that because only company reps and the authorities can access that.

It is not autimatically cancelled. Working Visas are cancelled by the employer not because they want the ban to take effect immediately but because they intend to use the visa again to new employees. In your case, your company has a handful of available visas, so cancelling your visa was not a top priority.

Your only option now is to get a NOC from your previous employer, otherwise the ban will only take effect after they cancel the visa or when the visa expires. GOOD LUCK.

I left the company in the proper manner. gave my resignation, got a certificate of employment, surrendered my qatar id and professional license in qatar, i even got my gratuity, i did all the works 2 years ako. that's why I am surprised I am still connected to them.

I asked my previous sponsor if they cancelled my RP or not. I was told that the immigration usually automatically cancels my RP, 6 months after my exit and this is not their fault.

Is this correct? Or do they need to file certain papers for this at the immigration?

Did your previous sponsor cancel your RP, or did you jut leave with an exit permit and not come back?
