Deduction of money after termination
I was working in Qatar a reputed company since last 1year and 8 months. Now they terminated me from the job, The reason for this is they told me to relocate from Qatar to UAE to the same company in same job contract and salary, but I refused it. Because if I relocate from here there I have another job contract as per UAE labour law and also i should finish the Min. contract there too. But the Main problem is there are some clauses in my labour contract. They mentioned in my termination letter like this
“since you have refused to accept our request to relocate to the UAE where the company requires your service, we have decided to terminate your employment contract, as you know the refusal is a violation of Clause (d) in the contract. Accordingly all the loss incurred to the company due to this shall be recovered from your service indemnity/ outstanding salary.”
Clause (d):- Geographical area to work , They mentioned some five countries
Now they are not ready to give me NOC and also they will charge from me some Visa charge for UAE QR3000. Is there any law point to get me NOC and avoid the deduction.
But you signed a contract right? So must be you know this as it is stated in your contract?
The reason is they are not givng me the exact job.MY designation and job they are given is not matching.
My designation was engineer, I was doing even Labour job in the site. There is no carrier growth for me.
And the situation is more worst in UAE than here. That is why i dont want relocate there. I told them am ready to go in visit visa. Now One month am in room without salaryand they are also gng to deduct ma outstanding salary.
You have violated your Contract Clause (d):- Geographical area to work in five GCC countries including UAE.
Therefore your REPUTED company is right. They dont punish you un-necessarily. Best thing would be to accept your transfer / relocation and work in UAE. What is the problem in that ?
