Termination of Contract (physical assault)

Hello Everyone,

I worked in a company here in Qatar for almost 6 months and decided to submit my resignation (Resignation/Termination of Contract letter signed already by General Manager) because our Project Manager "punched" my directly and began shouting at me for no justifiable reason. In this case I believe my Termination is of "Immediate Effect".

My questions are as follows:

1. What does Immediate Effect actually means?

2. Does the company have the right to refuse me an NOC (release)?

3. Do I still have to hand over my jobs and responsibilities in a given or specific time?

 I would appreciate any clarifications, advices and insights.

1. from the date you get official notice all your work is terminated. you should start for hand over.

2. yes company have the right to refuse

3. 1 month notice period for hand over and then all your settlements will be given to you

so till then be a good boy till your final day is in office.

Very valid questions

1. What does Immediate Effect actually means?

Ans: As per rule company should give you one month notice but in your case, you should not report to duty from the time of receiving the notice but you are entitled to one month salary.

2. Does the company have the right to refuse me an NOC (release)?

Ans: As per current rule, your company has full right to refuse.

3. Do I still have to hand over my jobs and responsibilities in a given or specific time?

Ans: yes

@acchabaccha, Thank you for the response. I am bothered by the idea that I need a minimum amount of time (for the company to find replacement or train somebody else) to leave the company. My company said they will give me release as long as I have a letter from another company mentioning I am working under them or provide an offer letter. So, I only need to hand-over my job to the responsible and find another company, right?

@britexpat. Why I resigned? If you're in my position, would you like to work with someone who easily succumbs to violence? No one has the right to punch someone, no matter what the reason. Also, I already filed a report as well as a letter saying I will terminate my employment and It was already signed and approved/accepted. And thank you for the information!

As Britexpat has very correctly suggested, you should file a complaint against the PM with the management of your company, if what you state is true. This would come on record and may lead to some action if the PM repeats it again with someone else later on. A good way is to do it through email with copies to every responsible person in the management.

It is best to look at your contract and also the Qatar Labour law - http://portal.www.gov.qa/wps/portal/topics/Employment+and+Workplace/Human+Resources+Law

I don't see why you resigned. If what you say is true, then the PM was at fault and you should have filed a report against him with HR

"With immediate effect" means you are not on the job anymore after receiving the termination letter from the company. The company does have the right to refuse you NOC even if such an incident had not taken place. The issuance or rejection of a request for NOC is totally at the discretion of the management of a company. Since you will no longer be in employment, you may be asked to hand over your job responsibilities to some other person. Should you refuse to do so, the company may hold back a salary but you can always approach Human Rights Committee or the Labour Office for assistance on this or any other issues with regards to settlement of final dues and exit.
