Transferring to competitor company
By bernzkilot •
Dear Sir,
Good day to you! I want to transfer to another company but that company is a competitor but they have better offer and better work opportunity than the one im working with right now so i just want to ask. Is it possible to transfer to another company but it is a competitor? Please advise me. Thank you.
If your contact with current employer is not having any clause preventing you to join a competitor, I think you can go and come back in new visa.
Re-check with some typing center or legal firms who can advise you on the rules.
@pioneerpec
Actually i didn't know this rule before and my manager was close to me as well. without my knowledge, i have informed him that it would be a freight forwarding company as well then he told me that we cannot let you go if you will transfer to a freight forwarding company too. should i just tell to my employer that i will be going back to Philippines for good so he will cancel my visa and i can come back? or can he trace it if the new company will give me their visa. please help. :(
@bernzkilot
This rule is in effect if the current employer wants to prevent you from joining the other company. Why do you need to tell them this. Cancel your ID and comeback on new Visa.
Hi Sir Pioneer,
AS per the rule, it says that i cannot transfer to a competitor. my current job is quotation to customer, customs clearance, customer service, invoicing to customer and handling some of accounts as well. but in my new job, i will be doing all quoting to customer only. please someone help me what can i do? :(
Qatar Labor Law 14 of 2004 (Article 43)
"If the nature of an employee’s job is such that he/she has access to confidential employer business data that may be harmful for the employer if leaked out, then if that employee wants to switch jobs, the current employer has the right to stipulate that the employee will not compete with them or join any such organisation that is a direct competitor for two years. This stipulation will only be valid if it is restricted as to the place and to the type of the work to the extent necessary to safeguard the current employer’s lawful interests."
No problem for employees.
This rule is for Employer.
That is ..imagine I am a partner in a Rent a car company with a Sponsor, I cannot start another rent a car company with another sponsor without permission from first sponsor.
So this rule is for Employer not employee...that is ...it is not for u..you can join anywhere...
Its like a pilot of Oman air can resign and join Kuwait Airways...after all he is a pilot..he cannot drive a truck..to avoid competition :)
I have not yet finished my 5 year contract. I am only 2 years and 7 months in my current company. Is it possible for me to transfer to a competitor? Please advise. :(
Should not be a problem is you have completed 5 years with the current company and you have offer from new company. You can apply at http://e-notice.adlsa.gov.qa. Alternatively you may contact some typing center regarding how to apply for employer change through ADLSA website. They will help.
