Resignation issue
Hello! I give my resignation two months before my license will expire. But my employer did not grant it saying that i need to find a replacement before i can resign. I will be the one who will look for someone to replace me. If no replacement i cannot resign. The problem is no one accepts their offer because of low salary. What should i do? I know that it is not my obligation to find someone. And he said that he will not give me anything including my COE and gratuity if i push my resignation. My contract is already expired and i dont know if it is a legal contract because no stamp from MOI. Thank you for your advice and help!
Thank you acchabaccha. What about my invalid contract? If it is not valid in court? What can i do?
If your contract was not registered than it is of no value in the court. Your employer cannot force you to continue working if you have resigned. Suggest, you report the matter first to the National Human Rights Committee (NHRC) and then to the Labour Court. When you file your case at the Labour Court, mention you were not given a legalized contract by the employer. The Labour Court will force your employer to let you go and also pay you your dues.
