Dear All,
I am engineer,working in qatar. my contract and my visa is going to finish within one month. My sponser is not ready to provide NOC for me. My doubt is once my contract finished means, NOC is required or not to change my job.
NOC is totally in the wish of Kafeel,. only way win his heart and try to get NOC by love.. other wise 2yeras byby qatar
KIWIINQATAR1234: As per Qatar Labour LAw # 14 Year 2004, "Section 53" The WORD "service certificate" Does not speak about NOC. It Understood that the employer should provide employee , his "WORK EXPERIENCE CERTIFICATE" upon request by the employee. There is no ground speaks about NOC in the whole Qatar Labour Law.
Article (53) (What you are looking for)
The employer shall upon expiry of the service contract:
Give the worker upon his demand, free of charge, a service certificate (NOC) indicating the date of his engagement in the employment, the date of expiry of his employment, the type of work he was performing and the amount of wage he was receiving.
Return to the worker the certificates, documents etc. which the worker deposited with the employer.
So if you have completed your contract your boss needs to give you NOC and any other documents that he or she has regarding information on you.
n respect of the workers who receive their wages annually or monthly, the notification shall be given not less than one month prior to the date of the termination. If the period of service is five years or less. If the period of service is more than five years, the notification period shall be at least two months prior to the date of termination.
If the contract has not been renewed and the parties thereto continue to abide by it after expiry of its duration without an explicit agreement, the contract shall be considered to have been renewed for unlimited duration on the same conditions provided for therein. (Article 40)
So make sure you tell your boss you intend to leave when your contract expires.
