there is no such thing as orfi marriage..

Any marriage under islamic jurisprudance that satisfies these 3 criterion is a lawfull marriage in the eyes of God..Whether or not it is registered in the " state record" is a " legal" issue, not a " religious" issue

1) Exchange of affirmation that both parties do indeed want to be married to each other

2) At least 2 whitnesses

3) A gift( dowery ) from the man to the woman of any size..

ideally a marriage should be publicised , but should " special circumstances" of the couple ( or by mutual concent) they agree that it is better to not publicise it, it doesnt make it any less lawfull in the eyes of God.

It is very different than having an affair in so far as the " wife" enjoying all her marital rights ( except those she willingly releases the man from", and should she get pregnant, the man has an obligation to accept his fatherhood of the child and provide for the child and the mother..
