Can Black listed company give exit permit?

Dear QL'S
How can I get the exit permit?
My brother's company was black listed and hence his
RP has not been renewed(which was expired on 30.3.2010)
He is ready to go back, but his company said that due to
black listed can't able to do anything through MOI.
Refused to issue NOC too. We feel very sad and in this
critical situation help us ie how can I send back my
brother?
If anything unhappened who is response?(the company or
the sponsor?)and how much penalty will be paid if any
delay occured?
