Delay by THE LAND REAL ESTATE CO

I purchased an apartment on the Pearl through the Land Real Estate Company.

One of the conditions in the contract was that ihe project would be complete by the 30th June 2008, if not they would pay penalty charges of QR 30 per sqm so long as they gave 3 months notice.

I recently received a letter from The LAND stating that the project would be delayed until the 31st December 2008. The letter was posted on the 12th May via registered post with Qtel.

Inside the Land informed me about the delay stating that as per the contract they can delay the project so long as they gave written notice. This was infact incorrect, they puposely missed out the 3 months notice section from the contract. They also stated that I am not allowed to claim amy damages from them.

The letter was also dated the 30th March. They did this to try and cover themselves under the 3 month clause.

I have written to the Land complaining to them about their notice and claiming the delay penalty.

I know of some other people who have received similiar letters backdated to the 30th March but posted in May. If there is anyone else please let me know as I am sure I will eventually have to pursue them legally for damages. If anyone else is in a similiar positiion please contact me.
