Hidden Company Policy

I have a problem

I am guy with an open contract and has already passed the probationary period of 3 months. I am now on my 5th month+. I have recently resigned due to a great opportunity in UAE.

The problem arises when the company is now charging me with my incoming and outgoing ticket. I know it is my responsibility for my departure here but for the incoming ticket to be paid to the company? It is not stated in the contract, only "employees who resigned shall be responsible for outgoing tickets", AND NO INCOMING.

Now they are saying that it is a company policy.

I thought that we are only binded the contract as stated.

When I go home, I have no money to bring:

These are my deductables:

1. Incoming Ticket
2. Outgoing Ticket
3. Unused Visa cost = 1200QR per 365days
4. Internet etc. if any

The company is getting back at me.

Labour Law, Article 57

"Upon termination of the service of the worker the employer shall at his cost return him to the place from where he has recruited him at the commencement of the engagement or to any place agreed upon between the parties."

There is no mention of any conditions, so the employer has to pay your outgoing ticket.

The other issues are not specifically mentioned in the Law so that would be determined by the contract, but stand on your rights regarding the outgoing ticket.

I think MZ AND PARTNERS is the most influential company here in Qatar. Because it is their company policy not to give GRATUITY PAY for the time served by their workers. This has been the practice since they started and until now even if there's already a complain before they are still firm with their policy. They are more powerful than the Qatar Labor Dept.

It seems to me that Qatar labor is not keen on implementing their laws not unless maybe it's already alarming. I have a friend at MZ & Partners, and she's been there for 3 years. When she resigned accoring to her boss, it's a company policy not to give GRATUITY PAY.

Yes that applies to every expat who signs a contract.

u've followed whatever is in the contract ie gave 30 days notice...but still the exit has to be given by ya company....if u argue more ur exit will be delayed...my advice wud be to solve the issues amicably or atleast u can request 'em to deduct less money...nwayz u said u have a good offer in UAE....and u can work for 2 yrs and come back to qatar...so ya NOC issue is also solved.Think with a cool mind

nor a rule of thumb but many companies here will charge you the amount of expenses to bring you here if you resign less than a year. Some companies will have it pro-rated during the first year.

I do not know if it is legal or not but it is becoming a common practice. Try to get advise from Labor Department or POLO/OWWA (since you are a Filipino Citizen)

From Article 70 of the Qatar Labor Law:

"The total of the sums to be deducted from the wage of the worker in settlement of the deductibles and debts due from him shall not exceed 50% of his aggregate wage. If the percentage which shall be deducted from the wage of the worker within one month exceeds this percentage the deduction of the excess percentage shall be deferred to the following month or months."

Would this apply to me?

I am expecting a 4000+QR deductibles (by just legitimately resigning) as per the "Hidden Company Policy" and my basic monthly pay is just 2500+QR.

I am just wondering why such people/agency exist. And a matter of fact that the HR superintendent came from the same country of mine.

The one amount they are charging me is way beyond my basic salary.

@beast2009: I have rendered them 30 days notice period as per contract.

As a matter of fact, I am abiding everything in contract. Too bad for me I abide by the law and being 'too honest'. I should have taken an emergency leave instead and never return because still if you resigned, or completed your contract duration, or take an emergency leave never to return, my company still gives no NOC.

This would be my advice to all who want to leave and have just a little financial 'liabilites' to your employer.

Probably your period of services is too short with them to recovered back the cost of your itinerary. They must be thinking you as a stepping stone type.

I believe it is the company's responsibility to repatriate you, no matter whether you resign or not. I also think that they cannot charge you for your visa full stop. That is a company expense according to Qatari Labour Law I believe. Call the Ministry of Labour and ask them.

Unfortunately, there are many companies here who try to claw back their expenses in hiring employees and do so illegally but employees are too frightened to stand up to them.

just do the "cost benefit analysis"... how much u will loose from ur new job in monetary terms if because of arguing with ur company here ur exit is delayed by the company...

follow the contract...everthg void outside the contract....if things r gettin difficult then it is wise to succumb to 'em.....and join ya new job asap...remember u need a exit permit to leave this country

Not applicable as per the contract but I personally feel if you are resigning so soon, company should be refunded all the investments they made on you.

if u resign after ya probation...the u need to give 1 or 2 months notice...according to the contract....yes u pay for ur outgoing ticket....but charging u for the visa process and the incoming ticket is not rite...it no hidden policy....if somethg is mentioned in contract then it is applicable...or else NO
