Whom to i need to go to get my money back?? Pls help

I was looking for a house & happened to meet up with one of a small time realtor. He showed me the house & I immediately paid him an advance of QRS 500 to reserve it for the month of Feb, 09. This happened almost 15 days back.

But since my plans changed , I informed him that I will not be able to take that house after 2 days of paying advance & asked him to return my amount. But he seems to be very reluctant & is not even picking my calls. I even happened to go to his office but he was not there. Its my hard earned money very bad to feel that I will loose it. I u'stand that it was my mistake, but should I loose this money??? He has given me a receipt for the money I paid him. It just mentions the amount & nothing about the service or anything offered...

Tell me how do I get my money back. Should I feel that it is money lost and forget it?? Can i report it to somebody even though it is just 500 QRS....

Pls let me know if I will ever get this money back...

brother , its a rule here in Qatar , once you pay money doesn't matter how much it is , unfortunatly non-refundable. ITS CALLED "BAYANAH" .. As the person you gave the amount to is not responsible of changing your mind. He/she do work hard to show alot of people the homes of their criteria and then you book that for you , so its not possible to get your money back. Thank you !

All of the answers above seemed to be not "caring".

Even it is the middlemen's right to keep money, it is still your sole right to ask for reimbursement of the same since there was no actual/ physical consumption of the premises here, and therefore there is no consummation of the contract. The middlemen has the right to keep the money if you continue to rent such flat/ villa, but it wasn't.

You are in good faith while you said that you cannot rent for some valid reasons and such, he is obliged to return the money.

If he still refuses to return your money, you can seek the advise/ help of the police for this matter.

Well, tallboy & wassimi wat ur telling is logically right... But I have got back to him in a matter of 2 days and told him that I will not be taking the house. The person who was staying in this house has already left this house almost 15 days back & they did not spare him even for a single penny. Poor fellow he paid the whole months rent.. Now, I am sure they wud have got another customer cos they usually advertise on QL hunting for customers. Immediately after I told them I noticed an ad on QL for the same house. Post that it has not been repeated. U guys know how property moves in Qatar. My feeling is they have already made money out of this house but then again why make this additional QRs 500 from me...

Personally i beleive it's his right to keep the money,

this is the deposit, down payment or whatever you want to call it, is to reserve the place for you, till you are able to pay him the full amount.

Let's say you didn't pay him anything, and just told him i want the appartment, would he keep it for you?

if yes, then it's your mistake to give him the advance payment!

if not, then it's his right to keep the money as the money was the guarantee and by you taking the money back means you are taking from him the guarantee???

take care next time, i personally would recommend not to pay until you are sure from what you want!

Well personally i would say the other guy who is holding your money is right in this case. You paid him QR 500/- and confirmed your intentions of finalising the deal and he turned down all other people willing to finalise. Now if you change your mind he looses his major commission part and has a right to benefit from your deposit amount till the time he finds a new customer for his apartment. Have a big heart man. Just say cheers and forget it.

Pal, this person worked hard and searched to find you an appartment and the 500 Qr was like a gurantee, so if you wanna change your mind and not take that appartment, it would sound to him as if you are playin some games and he is not able to bare your mood or personal circumstances...i think you cant get it back !
