Can anyone help and give me any advice. I have been on an accident last week and it was not my fault but and my car got totaled (bought it on january of 2020) and they said that the islamic insurance (insurance of thecar who hit me) will give us the money to clear out the car loan but it is not enough to clear the loan because of the car depriciation (2% monthly) and the finacing company is still asking for about 5,000 qatari riyals from my own pocket to clear the loan. But they said they can still repair the car and will give us 25,000 only for the repair but the total repair cost is 50,000 so i still need 25,000 from my own money for the repair which i think is not right because the car is still 9 months old and 4,000km only and it is still under Comprehensive insurance. Bottom line is if i will cancel the car i will need to pay around 5,000 and if i will repair i will need to add 25,000 but somehow i manage to talk to the service center and they said they will be re estimating the total cost and then inform us im hoping that it will be under 25,000 only because that is what the islamic insurwnce will be giving and they will not cover the total amout of repair which i do not agree because my insurance is comprehensive. any opinions or advice will be appreciated, if any of you guys have been on this situation please help me some says i should bring the case to the court but i think that will be more harder. Update: I received a call from my insurance saying that the new estimated repair cost from kia is 28,000 but as i sad the islamic insurance will cover just 25,000 cost of repair so there's still 3,000 difference :/

Ana, you are in a predicament.

QIC is a highly reputable firm. I think they provide another vehicle FOC due to accident.

Yes, you will not get full 48K due to usage of 9 months that is expected, I cannot comment on the 38K. Any vehicle after it leaves the s/room looses 30 to 50% of its value, thereabouts.

Also, I think your loan provider is charging you the 5K as it is a full pay off during the 1st year. Per my knowledge, there is a fee if you fully pay off during the 1st year. They are loosing money.

I would recommend you visit your insurance and ask them to help you out for a higher value (which is doubtful) or they can claim from the other insurance firm.

Whether the lady that hit you accepts or not, by Qatar law, anyone ramming you from behind is at fault due to not maintaining enough distance.

Is she a Kebra driving school student/employee or the vehicle is a kebra driving school property. That could be a reason.

Just my thought, ff your insurance is giving you 38K+, you could go back to kia and ask for an earlier year new Picanto Line 2020 and pay the difference, which would be good as it will be an unused brand new vehicle, no monthly installments, 2021 vehicles will have arrived so they will want to get rid of 2020 vehicles. Just my thought.

Once again thank you for your response and for the advices you said.

Some of you are still confused so I will try my best to explain it clearly.

I bought a car from kia on january 2020 and it is under COMPREHENSIVE INSURANCE by QATAR INSURANCE COMPANY (QIS) with a insured value of 48,000 QR

Last 3 weeks if im not mistaken, i had and accident and it was not my fault at all. I was going 30km/h and all of a sudden a mitsubishi pajero just crashed on the back of my car (She said she stepped on the gas instead of the brake) and because of that i hit the car infront of me and that is kia sportage. Moving on we went to the police and good thing she took responsibility for everything and so we waited for the police report. The next day we went to our insurance and showed the police report and everything and we were told to bring the car to KIA Service Center by our insurance and so we did. after a few days we received a call from KIA that the car was getting canceled or labeled as TOTALED and i thought that because of this I will be getting a new car from my insurance but after going to my insurance again they said that they will be giving only 38,000 QR instead of the full value of the car which is 48,000 and that is written on my insurance paper also they explain why i got 38,000 only is because they will be deducting 2% from the total value of the car each month starting from the purchased month. I thought with this value i can clear my car loan but the first finance said i will be needing to add 5,000 qr to clear my car loan and that will be from my own pocket.

So i told my insurance that i dont want it to get cancelled and i want it to be repair so I went to my insurance and they give me some advice and everything and then told me to go to Qatar Islamic Insuirance and told them that i want my car to be repaired but guess what they will be giving just 25,000 for the repair while the total repair cost is 50,000 (according to KIA service center) so even if i want to cancel the car i will be paying 5,000 QR or if i want to be repaired i will be adding 25,000 to complete the 50,000 cost of repair. They also mention that if we want we can bring it to the court otherwise accept the 25,000 qr

Angelo - My insurance company is Qatar Insurance Company (QIC) and the insurance of the lady from al khebra driving school is Qatar Islamic Insurance. About my car I bought a Kia Picanto GT Line 2020 with the total insurance value of 48,000 QR

goodlittleboy, I understand very well what a comprehensive insurance is. It covers you even if you set your car on fire. However, the owner of the car who causes an accident MUST have the legal insurance which MUST cover the cost he caused. Otherwise, the insurance that everybody HAS to HAVE would make absolutely no sense!

At this rate, looks like your insurance firm is not a reputable one and also the lady's Islamic Insurance firm is aware, hence taking you for a ride.

I cannot believe, they are telling you to pay Qr. 5K or Qr. 25K, in which case you can buy a second hand reputable brand of vehicle.

Mind if I ask the name of your insurance and the Islamic Ins firm also the brand of your vehicle.

If your vehicle was totaled, I can only think of Korean and now Chinese vehicles. - Sorry.

Ana, as GLB says go to the captain and plead your case. Or I would go to MY insurance and tell them, "I cannot accept the charges and to deal with the other party insurance and get my vehicle repair to the fullest or pay me full value of the vehicle, also I do not mind going to court and put my case through. I would also put it in the NewsPaper about XYZ insurance being a fraud and publish my experience."

You have comprehensive insurance, so if you damaged your vehicle, your insurance firm would pay for your repairs completely, however since a third party has damaged your vehicle, it is the third party who has to repair your vehicle completely since it is not even 1 year old, complete new parts have to be used or if it is totaled the 3rd party has to provide you an financially equal vehicle.

Fight for your right.

Daniel: That's for third-party Things change when a car carries "comprehensive" insurance cover. A good insurance company takes care of all the cost of damages. It also takes care of injuries to the driver and passengers of both vehicles. That's where "comprehensive" insurance differs from third-party. You must be aware that "comprehensive" cost almost thrice as much as third-party insurance. It happened to my friend whose car was hit on the rear side by a speeding car. His insurance company sent him over to one of its designated garage for the repairs. He never had to go over to the other person's insurance company to settle his claims.

Third-party liability is the minimum legal requirement which covers you for any claims made by third parties for damage or injury caused by incidents where you are the driver at fault. That's what the law says. and it is clear enough. The minimum coverage is to cover claims made by a third party if you cause the accident. Voila!

goodlittleboy, I disagree. Once a truck reversed from a parking spot and hit me while I was passing. I called the police and they decided that the truck driver was at fault. The told me to go to HIS insurance, which I did. They paid the repair cost. And that's how it should be.

Daniel: True. But that matter is between the two insurance companies, the insurance company which has insured the this vehicle and the insurance company of the vehicle that caused the accident. The insurance company of this person's car must settle all claims of damages and then claim the amount from the other company. This person has nothing to do with the other person's insurance company. They may not even talk to ana if they wish not to.

The obligatory insurance everybody must have is meant to cover damage YOU cause with your car. Have you done any damage? I think you haven't. So, the only one who has to pay for the damage is the insurance company of the car owner who caused the damage!

You should not have gone to the insurance company of the person who hit your car. They have nothing to do with. You can only claim from the insurance company that has insured your car. I believe they are trying to simply "slip out" of their responsibilities, that's all. Suggest you go over to the Traffic Police Head Quarters at Madinat Khalifa and meet the Captain. Explain to him all that is taking place between you and your insurance company. Ask him for help and assistance, Hopefully, he will guide you on the best course of action. Captains speak English and you should not face a problem in conversing with them. They are very helpful, understanding and cooperative people. Just give it a try.

I already went to my my insurance company and to the insurance company who hit me. But as i said the insurance company of thr lady who hit me is not covering all the expenses for the repair.

Ana, sorry, my confusion is about you not going to your insurance firm (instead of trying to handle it on your own, you do not know the fine print or speak the local language and most likely will not have the finances to go legal over the mandatory Qr.1,000.00 court fee ) and telling them about this accident.

It is in their interest that you get the max value.

Of course, the other person's insurance firm will wish to pay as lowest possible. It is their bottom line (Profit) which they show at the end of each financial year.

Each of these insurance firms have their paid lawyers to handle legal cases. Let yours earn their keep, You paid for it man, They have guys that speak a common language and know the loopholes.

As I understand it, the accident wasn't your fault. In this case the insurance of the other party has to pay! You will need a statement from the traffic police about whose fault it was.

Yes my car is under full comprehensive insurance because my car is just 9 MONTHS and it is worth 48,000 written on my insurance paper and if i want to cancel the car they will only give 38k (48,000 minus 18% since 2% car depreciation each month) there there is still some remaining balance on my loan and they said that i will have to take it from my own pocket. and for the repair the cost is 50,000 and the insurance is only giving 25,000 and the remaining 25,000 will be from my own pocket which i do not agree at all. I guess ill have to bring it to the court. I also want to know if i should contact the lady who hit me in the back (shes from al khebra driving school) sad to say she stepped on the gas real hard instead of the brake on a 20 speed limit

I agree with Angelo in that the insurance company is playing with you. As I have suggested to you earlier, tell them you are taking the matter to the court of law. That will make them behave professionally and let your have your justified settlement. You just need to be strong and take a hard stand, that's all.

Only getting the BALANCE loan amount from the Islamic Ins, is not enough, you should be getting the full car value (or less % for 9 Months) as it is new and they have charged the other guy full for his insurance policy.

Sorry, I am confused,

You do have comprehensive Insurance? Is the firm aware of the accident? Are they accepting the response.

From my knowledge, 1st year insurance allows you for 100% brand new original parts and if the car is totaled, has to be replaced.

My advise, let your insurance firm work for the insurance money you spent, and tell the traffic dept you are willing to go legal if you do not get full compensation. I think it is Qr.1,000.00 for Court.

I think this Islamic Insurance is playing you.

While you have tried your best to put the matter across at QL and I appreciate that, there are some queries that remain unclear. You must have insured the car for some value and this should be stated on your insurance policy. If your car is a total wreck and that is the way I see it from your post, the insurance company is liable to pay you the total amount of the insured value. You can tell them that in which case they will take ownership of the car and sell it off with or without repairs to recover some money (known as "salvage value"). On the other hand, since your car carries a comprehensive insurance, the insurers need to bear the cost for the total repairs. In such cases where the insurers get the car repaired at their designated workshops, they usually charge 50% of the cost of spares should you opt for replacements with original spare parts. However, if your opt for non-original spare parts replacements (known as "Taejari", there are no charges on your side.

Insurance companies vary in their dealings with the clients. Good insurance companies live up to their commitments. Insurance is based on TRUST. Good insurance companies live up to that trust and come to the support of their customers when they are in need. As such they build their reputation. Others, just turn away their faces and find ways to slip out of their obligations when the client is need. I guess that it what is taking place with your insurance company. Should this incident have happened to me, I would not paying a single dirham from my pocket. I would take a hard stand and threaten the insurance company telling them the matter would go to the court of law. That should be sufficient to make them behave properly.

Just weigh your options, and take the best decision.
