i would like to ask for some help about the cheque that i have now, its almost two years since it has been given to me and the peson who promised me to pay it is still not paying me.. is it possible to sue him?..any idea?.. thanks in advanced..
Imran is right. First, very cleverly get a new cheque from him handling the person very diplomatically and in a friendly way so that he does not get to understand your next move. If you are successful, then you have some powers in your hands. I am very hopeful that he would return your money once his cheque bounces and you have the letter from the bank in your hands. The legal option is no doubt there, but it may take you months of running to the court to get a judgement.
Check with the bank if the cheque is still valid. If it is, then you can present the cheque for cashing. Since there will be no money in his bank account, the cheque will bounce. You can then ask the bank for a letter which would state the cheque had bounced. Tell that person of what happened to his cheque and that you have a letter from the bank about it. If he still does not pay you back, you can report the matter to the police based on the letter from the bank. They police may block that person's bank account and even his exit from the country if he is a foreigner till the matter gets sorted out.
