How to calculate End of service (EOS) calculation in 2019

Need help.....if someone knows.

I am working with the same company for more than 6 years and now I am terminated. They calculated my EOS as per 21 days per year but labour law shows 21 days for the first 5 years and 28 days after 5 years.

is it correct or i can take any legal action and how?

please guide me if possible.

Sohail: I suggest again you pay a visit to the NHRC office. I am sure they will guide. You will be sure of everything then as you will be getting the information through an authoritative source.

FYI, i wasn't terminated due to misconduct. There is no more job in company and they have terminated almost 75% of staff.

Morane: Thank you very much for your advice. I am a non-smoker and as such sheeshah is out of the question.

Molten has been at QL for several years now and through these years she has fought with many people due to her "thinking", comments and other acts. Many of these people have either left or have stopped writing at QL.

I do not have any problems with Molten Metal. I write only when this woman misguides people, tells lies, make false promises giving hope to people who ask for help or advice. The newcomers accept the "advice", comment or promises of this woman. They do not know the t-r-u--t-h behind the promises or "advice." Sometimes, these false promises or misguides from Molten are very painful to read. I believe this woman gets some form of pleasure from her acts. You may have noticed by now, many of Molten's comments are downright stupid and she has to comment at each and every post at QL, which does not bother me at all. But when I step in to advise people that Molten's promise is all false, the woman jumps on me and retaliates with several posts and pictures. I don't care.

Your suggestion that Molten and I sit and talk it over a cup of "tea and biscuits." I am unable to fulfill your wishes. I wish I could, but I just don't want to be driven mad to the point of no return. Molten is a mentally abnormal person.

from what I know, it is 28 days after 5 years of completion of service. I have seen people being paid as per this calculation. However, if there has been a change of rules lately, I am not aware of that.

In this case, I would suggest Sohail to go to NHRC and seek guidance before taking up the matter further with the company. This would clear things. I am confident NHRC will give the right picture.

Furthermore, if an employee is terminated due to misconduct, then it is a totally different story. Even in such an unwanted situation which is not common, an employee can always fight in the Labour Court to prove his innocence. It is not so easy for any employer to terminate an employee due to misconduct. Otherwise, unscrupulous employers and there are many of them around, would have used this tool to rob employees of their ESB.

I would respectfully disagree with Acha here about going to NHRC cuz there is a clause in law that mentions that if the employment was terminated due to misconduct of the employee then the employee is not eligible for gratuity. So, employer can turn this to his advantage if authorities are involved. Please suggest if otherwise.

From what i know from sheen services is that 21 days will not automatically increase to 28 days after 5 years. This is as per the contract. Unless the contract specifically mentions this increment after 5 years, the employer has right to give 21 days gratuity for "n" number of years after 5 years of service.

I guess you are right in your calculations. Suggest you send your HR people an email from your personal computer pointing out the discrepancy. If they still don't listen, take the assistance of the National Human Rights Committee and show them the calculations made by your office people along with the email you had sent them. They will help you out by calling your Managers. If the matter still does not get solved, NHRC will advise you to approach the Labour Court.
