Hi All, 

 

I am facing a problem with my bank. I have defaulted for two months and they already have filed a civil case against me. 

 

This is what happened to me in the span of two months:

 

 I resigned from my company to join a new one but one of my managers gave me a very hard time(no NOC) and the company I was supposed to join backed out because of it. Pulling out my resignation was already too late at this point.

 

I was expecting to get my gratuity after my resignation and this is enough to cover two months of my loan that is why I kept on promising the bank dates for my monthly loan which by this time is already overdue. One month became two months and just recently learned that I will only get my gratuity once my visa is cancelled which up to now is not.

Fortunately I have found a new job and my company decided to give me NOC with the help of one of my good managers(I wish I had done this earlier). I have informed the bank about this and they asked me to provide an Employment Certificate from my new company before the end of January. Which I was not able to due to my visa not being transfered yet. 

 

I missed a call last Jan 31 and I have a feeling that it was the bank. I tried calling it back but of to no use. 

 

Last feb. 4. I received a text message from The Courts stating that I have to be there on the 25th of this month at 9am for a court hearing of some sort(not specified).  

 

Today, 10th of Feb, I received a call from the bank and they informed me that they have filed a civil case against me. I asked them what should I do? They gave me two options:

1. Pay the total remaining loan.(impossible)

2. Provide a guarantor and a security cheque.(same) - most of my friends are in a similar situation because of the recession. And the ones that have work are not qualified to be a guarantor or not willing to be one.

I am willing to pay but it seems that the bank does not give me the choice to just continue with the monthly payment. Which now I can.

 

My question. What will happen to me if I can't do any of the options the bank gave? And If I go to jail, how many years do I have to be there? I hope someone can help me on this.

Tell your friend to follow-up with Al Rayyan police station. The clearance from the court/ prosecution will lift his/ her travel ban. A text message will confirm that. The bank's system is not the same as the Police's system. Sometimes the bank is not updated.

My travel ban was lifted right after I gave the bank clearance to the COURT.

i see, the situation is my friend already got his clearance from the prosecution, case was closed for bank cheques but still he has remaining balance which is being paid monthly) he was told to bring his clearance to alrayyan police office to lift his travel ban, when he checked with the bank, they said on their system there is still travel ban, it is just confusing if he is now able to go outside qatar since he has clearance from prosecution or still not possible because of the travel ban record from the bank.. any advise would be appreciated..

And also take care .in case you have to go to court . don be late or try to obs code. If you do they will give a warrant of arrest. and that day of the court if you wont have paid the banks overdue. carry money with you thats for cash bill which if you wont pay in 24 hours the cash bill is canceled until the next herring so you remain in custody. And if you ever see a call from a number you dont know make sure you pick it may it be land line or mobile as long as you have not settled this issue. and if you missed it and you suspect its from the bank you better go there and check. from the collection department. other wise you call them they wont care. all this am trying to tell you is through experience. i wish lack.but also pray for the lack.And note even if you go north or south all they want at last will be there money. you have 10 days more try something don lose hope.That cat and mouse of i was not payed so i dont pay and blocking and unblocking travels is not good music here. try your best to be out.

before anything .with this stage of your issue ,try and deposit in your account the much money you own them. Then ,go to the back manager and explain your problem. i think or rather suspect this is a bank that i know, because my friend hand an equal headache with you. We had to donate. another one went to check in capital police regarding the travel burn and was booked in . later a good police told him to pay the overdue and was let out. you cant tell them anything with out paying the overdue. Only the bank manager can save you. this all should be before the court day. then make a letter in Arabic to the Gearge not English, Arabic about your story. make sure its translated to Arabic before the court date .that is if the manager does not help you, and be sure to have paid the overdue and be sure not go to tell them that you will pay. And note that if your burn is not truly lifted then you will not get your new ID card. because you are already in black list which means no last dues from the last company. And if you are in black list and the police catch you anywhere in the street they will through you in. your medicine will only start effect when you pay that overdue. and if possible make sure that your new salary is going to that bank. if not so deposit the monthly pay always before the dead line given by your back. pay first and am sure they will listen. if you own an asset and you don have friends to help you out sell it better for you.If you go to jail who will be enjoying it anyway, go there tell them lets start with i payed you, my story flows from here to there and in the agreement i signed with you there is no where written i pay all at ones., its written i pay monthly this amount and if i fail i pay this fine for that particular moth and so i have done . but you must be very polite to drive this point don make them postpone there help to 26th.And you know whats fixed on 25th. if the manager listens then with a click off one baton you are free. take also the offer letter of your new job with you very important. i wish you lack.

1. This is weird but I received a text from Metrash that says my travel ban has been lifted. What's weirder is I never received any notification that I have a travel ban. I think I am clear coz I just got my Police clearance attested by MOFA yesterday(10-2-2016).

2. I hope that the court considers my argument.

3. I will do this before going to the court.

4. Hopefully it will all be done in 10 days time.

Note:

1. If there is no police complaint on your loan guaranteeing cheques, then there is no criminal case against u. Under a police complaint :Travel Ban is put up. To know that you can send your one of friends to check with the capital police, which they do it on a daily basis via on line computer, without any fee and any other formality. Only ID copy or number is needed.

2. If there is only a civil case in the court, then you can present your strong argument, which most likely the court will accept.

3. You still have the option to speak with one of the senior managers in the bank to help you out, which is also possible.

4. You can speed up the formalities with your new company and give the documents to the bank for loan rescheduling.

@yacine.h I hope the transfer happens as soon as possible and bank considers me paying them on a monthly basis.

@ EngrWrkingParsons it is both the bank and me created this mess. Not that I like it.

good luck..Borrow money from some one. talk to your friends. tell them that you will go to jail if they do not help...Marketing people in Banks have created this mess.

You still have two weeks. Hopefully you will finalize the transfer to the new company before that. Otherwise you need to convince a friend to pay it for you.

It's still a huge amount. Most of my friends here are in similar situation coz of the recession. I am just a bit shocked that the bank filed a case against me for a two months default. Not really sure if it's humane or not. It's not like I am going run or anything. I am willing to pay but it has to be on a monthly basis since I have work now.

very sad situation. How much of the loan is remaining?. Could you not find a friend to help you pay it off and pay them back?.

I have a feeling that I will be put in jail after that hearing. I really don't know what to do since the bank gave me options which is almost impossible for me to do.

The only thing I can do is to pay the two months overdue once I get my gratuity and present them with an employment certificate once I get my visa transferred to the new company I am joining. I hope they consider it coz if it not I will surely rot in jail.

the banks are idiots - this happened to one friend of mine. He had to stay in prison until some friends and family arranged for a guarantor with a cheque for the full amount.

After this the bank dropped the case and the person started making the monthly repayments.

For sure, when you go to the court for the case you will be arrested - maybe they can arrest you even before that...
