I will be completing 2 years in a company in October 2016. However I have to leave in September for further studies for one year. Should I ask for NOC.

Dear Sheen Services,

The employer terminated the employee in a fixed contract (3 years contract). The employer terminated the employee on 2 years 10 months, just before 2 months of the contract expiry.

And he left the country by May2016.

Will he come back back. ? please reply.

Still he needs NOC to return to QATAR for a JOB....???

So, unless he gets an NOC, there is no guarantee that he can come back within two years - as we undedtand the law presently

What is is the meaning of OP?

Any body who leaves before 14 Dec, 2016 will not get NOC from Ministry of Labour, they have to request the company to give NOC if they want to come back to Qatar.

The Answer is NO. New system applies to the Visa approved after Dec. 2016. Employers may force all the employees under their sponsorship to sign new contracts valid for 5 years just before Dec 2016 and the employees can not change the company for 5 years.

Dear Sir,

Changes to Qatar’s Kafala law (Law No. 21 of 2015 regulating the entry, exit and residency of expatriates) will take effect on Dec. 14, 2016

The main reforms are that:

There will be a new system to appeal refused exit permits; and

Expats who finish fixed contracts will no longer need their sponsor’s approval to take up another job.

Previously, one had to wait two years to work in Qatar again if an employer refused to grant a شهادة عدم ممانعة (NOC - No Objection Certificate) to change jobs.

You can join new company on new visa through NOC which will be issued by Ministry of Labour after completion of your labour contract time period but if you want to transfer your existing visa to new company then you still require نقل کفالا (transfer letter) from your existing company.
