termination

Hi guys. I need some advice. My company terminated me yesterday but my manager still told me to work for 2 months. I was advice by our HR that if I will not do what my manager asked me they will deduct 2 months from my salary. I have been in the company for 12 years and as far as I know they should give me 2 months to find new job. But they require me to work still for this 2 months as they said it is in the Labour Law. Does anyone have an idea if this 2 months period of work is different from the 2 months that I should have to look for a new job?

I am not debating with you. Just stating facts. It should be on your contract.

The company may terminate you or you resign giving number of months notice as mentioned on the employment contract.

You can stay in country till expiry of your RP. However, if they terminate you and cancel the RP, you have to leave. While you have your 2 months period, you can look for a job while working with them. Some companies can also request you to stay back till the replacement is properly trained.

You can go to Labor, they may help you, you will have to keep an open mind. As long as your current employer has not wronged you, you need to follow law of the land.

@Angelo I know they should have given me sometime to find a new job since I have serve 12 years in the company. I think I should go to the Labour Department to confirm my rights as our HR is insisting that I still need to work as advice by my manager or else I will be deducted.

Also, they can not deduct 2 months salary since salary is paid in arrears, unless you have not being paid for the past couple of months. Most likely your HR said that "your End of service will be deduced by 2 months salary".

LamsheyF, per my knowledge, once you have worked more than 5 years, either party has to give 2 months advance notice

Better to work so you get your salary and End of Service Benefits. You may need to train the replacement in this period.

All the best in finding a new job at the same time.
