Hey,

I've been working in doha since 3 of may 2008, i presented my resignation for the 22nd of April 2009, and got a positive answer from the GM and they reserved my ticket on the 24th of april as i asked, fine......

then just now the HR tell me that the GM wants you to leave at the end of this month in 3 DAYS and he will pay you just this month!!!!!CAN HE DO THIS????

How about my rights???I mean at least giving me weeks to settle down my stuff, close my bank account...I mean shoudlnt he pay me my money?month of april till 22nd???
Shall i talk to a lawyer????i mean how can he do this????
pleaseeeeeeeeeeeeeeeeeeee i need advices, i am LOST!!!

According to your post you haven't finished atleast 1 year in your company, so they are right you will be paid only for your salary within the last month of your stay in the company & dont expect anything from them i mean any "compensation" of your end of service. less than a year. be happy because they're gonna provide your air ticket some company are not doing that if the employee resign. this is what really labour laws states.

This probably means that your company is a really good employer and went over and above the legal requirement. Whereas ttabet's was being strictly legal, as they are perfectly entitled to.

We all know that any company can choose to be strictly legal as the threshold or minimum limit but the extras (benefits, etc) are management decisions or extra legal (as opposed to illegal) considerations - depending on what management wants to achieve. You may be a very good employee - that the company wants to maintain a good working relationship with you - goodwill for the future. They are also protecting their reputation and corporate social responsibility, etc, etc. A good reputation goes very far, in encouraging investors, financial backing,etc. etc. and cashflow is always the bottom line for survival.

For some employees, sorry to say, not important enough AT THIS POINT in time. But like I said, the only thing constant in life is change and if the said employee improves herself - whether by experience or maybe get another (relevant) degree - depending on which field she chooses to work in for the long term, then things change in her favour.

The key is attitude. Anonymous said "Your Attitude determines your Altitude" and truly, it does.

Edit - Bleu is spot on - UAE different laws.

I had few problems working with Lebanese companies here. I am not saying that all are bad, but must say that some of them are making a name for themself..

Leave in 3 days but still be paid up to your proper end date, I trust? Good then, compensation for the trouble they caused you by letting you go off earlier but paying you up to April = paid "leave" and time for you to sort out your matters before you go home. Take care.

I didnt think anyone who served under a year got end of service. She should get her pay for the full notice month and thats it. I am not sure what other entitlements she has (as far as I know legally there should be none) but in all means she should approach her HR department as suggested and if that doesnt work just take her end of service letter to the labour dept.

Hmm.. are you sure, MD? Article 54, Labour Law No. (14) of the Year 2004 "... the employer shall pay the end of service gratuity to the worker who has completed employment of one year or more... not less than 3 week wage for every year of service... entitled to the gratuity for the fraction of the year... The first proviso ie. primary condition is that the employee must have completed employment of one year or more.

Yes, agree that ttabet's company is unfair to her in the sense that they are taking advantage of her. However, they are skirting around the edges of the law and they are legally entitled to do so in respect of the gratuity issue. As for the contract issue - if she has evidence of the GM's agreement to her leaving on 22 April 2009, then warn HR first. If that fails, then go to the Labour Office.

In respect of her rights - as per my answer in her earlier question and subject to Amoud's advice here in this thread - as the additional information is given here and the advice changes accordingly. Suggest read both and form your way forward.

you are entitled for a pay until April 15th which is the 30th day after March 17. If they will send you home by March 30, they should pay you 15 days more (until 15th April 2009). That is the normal situation. Now, talking about the abnormal situation..........................

No, you arent answering the question. What was the date of your resignation letter? Did you resign on March 15th? The reason is, if you resigned on or before March 1st, he can send you back the 31st. This is what I am trying to get. When you resign, just because you want to work until a certain date means nothing as all you are entitled to is 1 months notice.

the HR reserved a ticket for me on the 24th of april in my name, u think i can call the airlines and ask to send me this reservation by mail for a prove along with my resignation letter and a copy of my contract once i go to see a lawyer or anything related???

What additional things? The only other issue should be your vacation.

You can try your embassy for a free lawyer, but generally none of Qatars lawyers do a great deal of pro-bono work.

As long as there has been 1 months notice he can send you back any time after that. If the notice period is less than a month than he has to pay you the remainder of that month.

As for end of service, I am not sure if he is obligated to pay anything if you havent completed a year but MD said he saw it in the labour law so it must be so.

Go to your GM or HR department, tell them you need to be paid for the remainder of your 1 month notice period as by the law and also that you want your end of service. If they arent going to budge then tell them you will go to the labour department. You dont have anything left to loose right?

well leaving 1 month before the year coz i was taken in a company back in lebanon....so professionally i gave my resignation 1 month earlier so they can find someone meanwhile and giving me an answer now that we want u to leave at the end of this month???without probation?at least a week!!!!

there isnt a whole management, just a GM and the HR and she got all the employees in her hand!do u know what am talking about???she told me, you need to leave coz there's another girl who will live in your accomodation while in fact there's a 3rd room empty and its already for her, so she's lying!!!

I won't stop here, going after my rights!

just withdraw all your money, you don't need to close your account (but if you still can in three days, fine). Second, really don't know your reason for resigning (a month before your first year) but maybe was not taken in good terms by the whole management (maybe the GM is ok but what about the rest?). If they will pay you only until the end of the month, honest advise, take it and go home! Less complication, no problem. Your rights, really hard to fight for it, IMHO!
