Who's fault it is?

Hi everyone! I need someone's expert advice or opinion about the traffic accident I was involved in.

Apparently as per the traffic department's accident report it turns out that it is my fault.

Does the picture tells my fault? or is it the one who hit me should be blamed for the accident?

I already crossed the road when he hit me. He was obviously speeding.

This is a residential road. Notice the give way sign. Take a look at the skid marks of the tire who hit me. Can you tell how fast the car goes? He should be running below 50kph on that road but I think he was running double than the mininum speed limit and he clearly disobeyed the traffic sign in front of him.

Am I the one who's driving dangerously and recklessly here?

It's hard to accept that this has become my fault.

I think its his fault because the caution sign was for him not from where you were coming from. Which means you were on the priority road not him. You can show the pictures to the police & tell them what i told you

If he was going straight, he had the right or way, sorry to say.

DaRuDe is also right - damage on left, driver of that car is at fault, I was informed that the traffic rules are quite standard / clear - when I landed before the police station due to a moron doing an illegal u-turn from the right lane. He dented my front right and ran away cos his damage must have been on his left side.

I think a lot of the reasoning here goes thus...

If you have full insurance, you can "afford" to pay for the damage. The "authorities" don't realise that it adds to the premium for the next year.

Looks like the traffic sign is irrelevant with the intersection. It appears that you are negotiating a turn from a side road to the main road.

I don't know what the law is here but in Canada, the driver who has the last clear possibility to avoid the accident and doesn't take it is at fault no matter what the signage or right of way. Perhaps that's the view of the policemen/law here? It doesn't matter that there was a yield sign, you had the opportuniy to avoid the accident and you didn't take it?

I'm still not saying you were at fault but if that's the law, you might have to accept it.

Jackmohan I'm very much sure that I am not overspeeding when that incident happened bacause I just made a right turn a few meters away before that intersection as you can see the road in the picture.

I yielded even without the sign before I cross the intersection because the house on the left had four cars including 4x4s parked horizontally to the wall so there's no reason for me not to yield and look for oncoming traffic from the left because I have a blind spot but the other car can clearly see the yield sign in front of him and he disobeyed it.

Accident will happen if no one will follow or ignore the traffic signs and signals.

It's just that when I started to cross, the other car with no way of stopping & controlling the car because of his speed rammed me in split second. Honest to goodness if that car wasn't overspeeding he could have avoided hitting someone and stop in time. As the billboard says, "Over speed kills innocent lives" and he should realize that.

Stone Cold I agree with you... traffic department should act on it and fix the confusing signs before somebody could die in there because of recklessness of an over speeding car.

cops have put you at fault for a reason, you cant just call them unreasonable.

the other car was way too close, when you took the turn. the tyre marks show it.

If he was speeding, as a responsible person you should have given him way than trying to justify a "give way" sign on his side.

dbprologic ...I feel you both were speeding...ok maybe he was speeding faster that you ...so to say.

My reasons are:

1. You could have clearly seen the vehicle approaching and stopped if you were not speeding yourself.

2. OK The images are not tampered. Even if you took the picture later on you have placed your car where it would have been ...(looking at the debris).

3. The other guy too could have seen you clearly and must have expected you to stop (as I have seen a lot of locals "expect you to drive in a certain way" or try to "think what you will think" or "trying to read your thoughts" and drive accordingly.

4. The guy entering from the side lane has to be very careful while entering a bigger road.

So in effect the Police was right.

I suppose that you are turning out of the feeder road into main road where by right a straight or dotted stop line should be painted there in the first place. You are suppose to stop, look and go.

No dbprologic, it wasn't your fault, the red triangle is clearly indicating that the driver on this road HAS to GIVE WAY! He/she didn't, so the accident happened...Doesn't matter your intention (left, right, straight) the driver who face the sign supposed to reduce the speed until stopping the car and let you pass. Period.

So there is no reason why I should not take care, for me and my baby.

Yes I am turning left very carefully Mandi but the other car came from nowhere because of his speed and just ignored the give way sign in front of him....

I just notice that other car should stop as there is SLOW SIGN but in your way there is no sign at all so in this case your road is consider MAIN road and that's mean its not your fault but the problem here that may be you dont have WASTA here and you will faulty in every case.

but its your fault as you should stop untill the other car pass as the road of the other vehicle is consider MAIN ROAD. Regarding the speed matter so traffic police can give him a ticket for over speed but in accident yes, i am sorry to say that this is your fault.

Sorry, without the other vehicle in the photo it might be conjectured that this photo is staged (not saying that's the case but could be another perspective). Who's to say for example the skid marks weren't there before.

Also, if he was doing double (i.e.100kph) then I'd expect a LOT more damage to your vehicle.

However, perhaps he was going more slowly than you think - when the police came, had the vehicles been moved before they had a chance to survey the scene?

I have heard of this "the car on the left has the right of way" rule but then why does anyone stop at red lights or sort of slow down at stop signs? Why have a yield sign at all if the signage is meaningless and the rules of the road aren't enforced as per that signage?
