I am a filipina muslim convert living here in dubai. I am engaged to a jordanian muslim guy and we're planning to get married here in the court but the problem is i was married before with a christian guy and was separated from him without any knowledge of his whereabouts for more than 7years now. I want to know if according to islamic law i can remarried again and what are the things that needs to be done in my situation. Please help.

I have done a lot of things in search for him i dont know if he is hiding or just lost his way home. It's more than 7 years and still no news about him, do i have to wait for a lifetime for this person or do i have to go on with my life! My first husband never gave anything or any gift to me even before we got married so what things will i give back to him?

look, according to Islam,at the time of embracement of anyone, husband/wife ,his/her previous marriage contract is being cancelled; but you have to give back to the former husbend, all liabilities, gifts, presents that have been given by him earlier. This is the strict direction of Qur-an (chapter:60/verses:10-13)but if you both are coming to islam, you have to re-marry according to the islamic system. By reading these things you must have so many doubts and have to be cleared immediately by contacting any masjid in Dubai.

Your husband is not "nowhere to be found". Is he dead already? I think you are just convincing yourself that he is nowhere to be found because of your intention to marry this guy.

But my husband is nowhere to be found. He abandoned me for the past 7 long years without any trace that is half of our married life. It's confusing though!

You are still legally married. If you return to the Philippines you could face some serious issues if you re-marry.

in the Philippines there is no divorce but i heard that if you are separated from husband for a long period already, a certificate of singleness is needed and being issued as a requirement to re marry in a muslim court.for proper guidance, visit and ask the Philippine Embassy and an Imam in a Islamic Center, best if its where you are converted. be sure to take time in your decisions though.

And your question states that you are in DUBAI, right? Or is that DOHA? Anyway, I guess the location doesn't affect the rules, or is/are there any?

There is no divorce in the Philippines so meaning you are still legally married but separated. Hmmmm.

Take advice from local Muslim imam/scholar in dubai. This is very sensitive & crucial probelm. Anyhow, as per my knowledge, if the whereabouts of a husband is unknows for 6months or 1 year then as per ISLAM, wife is allowed to marry any other person as her current marriage will be considered VOID

.

Still, don't discuss in general public go to IMAM/SCHOLAR of ISLAM for this problem

Wow!! Completely changing everything you have ever believed in to be married to someone huh? Was your divorce from the Christian legal? Or are you still legally married?
