Yes, you can sue them. But usually it is a long drawn affair.

You can also confront the other company that bought the services of your employees. They are also to blame. It all depends on if you want to continue doing business with them or not. Companies don't want to make a big mess of these things because newer clients will feel jittery about the stability and the ability of the company to cope with these things and provide good service.

 

These are tough times for you guys. Grin and bear. Try to get out of this mess as soon as possible. Send a clear signal to other employees by firing these guys. If you had made these guys indispensable, then maybe you had made a mistake of not compensating them enough.

I think you can sue them for THEFT of something. 'cant remember the exact words now but the other posters are right. once you got enough evidences (legal proofs admissible to the court), you can KICK their BEHINDS without compensation (or out of the country).

It doesn't need a clause contract because this guy is working under this company, and made the same business and selling secrets...

prob is my friends money is still out in the mkt and the invoices has to be prepared by the culprit....omg this is soooo confusing, irritating and honestly making my friend sick...  hope things go smoothly. hope that @#@@@$%** gets payed for what he has done.

1. Do you have a employment contract with the employee?

2. If yes, does it have a 'non-compete' clause?

3. If yes, it is a simple case of breach of contract and you can close his business in no time. If no, you can do nothing.

 

The good thing is that you have learnt a business lesson. Put a 'non-compete' clause in all employee contracts. Don't be disconnected from the business. In today's business everybody have to add some value in whatever work they do - to the end user or client. If they don't this usually happens.

wallah...are they still working in the company?...fire them as soon as you proved that they are doing this...and don't divulge any more ideas to them...protect your files, soft copies and hard ones...as they may get more ideas to use on their "business" (if you can, check their USB's, if its own by the company, prohibit them from bringing so as well).....look after your documents...

 Immediately Jimmis, these staffs can be terminated  or suspended and they are not titled to any dues by the employer, during or soon the activity was learnt.

( I am not a lawyer or a prosecutor huh)

Violence is never an answer jimmis, and unless he made them sign contracts promising not to steal clients, then they haven't done anything to be put in jail for.  Sueing is the only way he might get some compensation. 

 

What they've done may be unethical, but it's his own fault for not better protecting his business.

If a worker of a company established or work for another without the permission of their employer, they could be prosecuted. This is against a business law. The empolyer of the company have all the rights not just to fire these workers but have all the right to prosecute and pay the damage of the company and the employer.

it is absolute cheating....he hasnt offered anything better than this company.what that guy is doing is he takes work and gives it another company and takes the commission.... isnt that cheating.

jimmis first thing need to do is get evidence or witness than confront him with the 3rd party presence as witness then if he confess then you can decide either fire him or give him the consequences by paying back all the damage he make. if going through legal system is hassle for you then this is close best thing you  can do.

in my opinion thats not called cheating..its a business and seems like a cut throat one... if they are "buying his clients" obviously they have something better to offer the clients then your friend has.
