Landlord - Agent Dispute - Help & Advice

Dear All,

I am in the middle of a big dilemma. Please find the below summary of the story and appreciate if somebody can advice further.

summary of incident

Kindly be informed that I have issued 11 postdated Cheques to the Agent I rented the house as a rent for the months of 05.02.2013 to 05.12.2013

Due to the conflicts between Landlord and the agent, I have received legal notification from the court on 22nd Jan 2013 stating not to enter the premises without the permission from legal landlord.

Further I have discussed with legal landlord and signed the new agreement and issued new Cheques for the house with effect from February 2013 to January 2014.

Now When I asked the old Cheques from the agent he is not willing to give me the Cheques and stated he also have the court order with all the rights to claim the rent for the building. when I initially called him on same day(22/01/2013) he told to sign the new contract with landlord. But now is not willing return the Cheques either.

Bank says they are not willing to stop the old cheque payment unless I obtain police report for the same.

When I go to police station (Messameir and industrial area)they said that they are not handling such cases in the police stations.

I am really depressed. In-spite of having enough workload from the company now this too in my head.

Appreciate if you all can advice possible next steps

somebody says to go to Public Prosecution office and file case. But before I do that I would like to have your opinion and advice for the same

I actually went to the capital polices yesterday with landlords mandoope.

They advised to go to the same court (Alsaad)which issued to court order in behalf of landlord and obtain a order to chq stop payment.

try police prosecution. if possible, talk to the land lord and get his help in finding a contact in the police to get any help for u in a legal environment.

the Syrian holds the guilt of breach of contract if the agreement given to him by the Qatari does not enable him in renting out the premises to a third party. with or without intention, you have now become a part of this matter.

it is a good point that the land lord is in favor of you and also a good point mentioned by ahamadsmarty yo maintain you bank balance at zero. but then again, when the cheques gets bounced, doesn't the bank hold the right to take actions against you or even the payee (the syrian) even though he is cheating on you with your own money? (do clarify the same with the bank) if not you will only fall in to more trouble.

if you are visiting the rental depute, make sure to go with a person who speaks fluent Arabic or the least hindi. this will make is easy for all the parties included in the conversation to understand the situation better. as of what i know, the agreement need not necessarily be attested by Baladiya.

its very simple.. do not keep any money in your account. always keep it zero balance. when the cheque is bounced, the agent will contact you. he himself will try to take legal actions for this. if you have enough proof that there is a 2nd agreement to void the first one, you win the case.

Agent is a Syrian guy. Landlord of course a Qatari National

Contract between agent and him does not contains allowing him to rent for third parties. yet he did that

in this context Qatari owner has reported the violation of contract to Qatari court(not sure which one)with results to give him a decision to evacuate the villa and to cancel any contract linked with it.

The positive thing is Qatari Landlord is in my favor and stated that he has the all supportive documents to proof against the agent.

All I need is to get a police report issue to bank for stop cheque payment for agent.

Should I go to Capital Police or Public Prosecution?

Yes it was not signed by baladiya. Now I have two contracts

first one with the agent - it is just a one page binding both parties agreement which was signed on 24 Dec 2012

second one with Landlord - 3 page agreement in arabic singed by me and landlord in every page - starting date 22-Jan-2013

This notification from which court? you have to follow the same court. submit a case there. other wise Department Of Rental Disputes located in Al Muntazah

this office can help you only when you have an official rent contract signed and stamped by Baladyia .

in this case Public Prosecution office is the correct place to get it done with immediate effect as there are Cheques and money involved .

i can feel the pain. ..i am also in the same scenario and i am kinda loosing money...its not that big but i am loosing.

I think I know some place where they resolve issues like that and that is Department Of Rental Disputes located in Al Muntazah I think that's the department which relates to your Issue.
