Cheating wives may have to pay too
India - Mumbai: A night spent in another man’s arms may land a married woman in the long arm of the law, if the Union home ministry has its way. Despite loud protestations by the National Commission for Women two years ago, the Centre is quietly seeking a response from state governments to the Mallimath Committee’s recommendation to penalise adulterous wives. The suggestion was made in 2003.
At present, only men can be criminally tried and punished for adultery in this country. A married woman, no matter how guilty, is treated only as a victim. No criminal charges can be brought against a wife for sleeping with a man other than her husband.

Unless the proposed law did not have proper checks and balances and would give men the right to claim their wives were adulterous without proper evidence. Perhaps the definitions were not clear, thus leaving lacunas and open to abuse by unscrupulous men. Very possible.
Also, is it possible that if there is an allegation of adultery and the woman gets put in police custody, there is the possibility of ill-treatment in police custody to extract (yes, strong word indicating "force") a confession, etc? There must be proper checks and balances, as I said before. Human rights must be protected. I'm guessing that there are human rights issues as the basis of the NCW's protests. We need further information. Things are not always what they seem at the outset.

2003? 5 years and counting ... hope it gets passed and hope enforcement is not going to be a problem. Proper checks and balances need to be put in place.
