Come back to Qatar
By Subramaniankannan •
- I have completed 2.6years in a company and I have a new job offer. I am currently under unlimited contract and my company will not provide me an NOC. Can I exit the country and come back again under the new company visa?
@Subramaniankannan - "Expats who leave Qatar and have had their employment and Residency Permit terminated, will be able to return to Qatar to take up employment immediately after being granted a new visa"
In short you can easily resign & leave the company now & come back on a new visa on any day, because you are now on an UNLIMITED CONTRACT. No one can block you entering Qatar in a new visa for sure !
Accha: ok thanks; so in that case, it seems to be the scenario that all the reforms and ministries still are ineffective at curbing the cruel dirty games companies play here with their staff; this is the biggest weakness for qatar and even though ill always love this place with all my heart; these stories of companies playing with helpless workers ache my heart and prevent my love story with qatar being a perfectly fulfilling one :-(
mohdata: From what I recall when the new rules were brought into effect some years back, I believe that if an employer is not willing to give an NOC, the employee cannot come back for a certain number of years (possibly five years.) The requirement of an NOC gets waived if an employee has worked in a company for a minimum five years. Also, from my knowledge, the Labour Office does not get involved in matters of getting an NOC for an employee from the employer. The issuance of NOC or its refusal, is totally in the hands of the employer.
Lastly, as for the cancellation of RP. I believe it should be done by the employer once the employee goes on final exit or it should be automatically cancelled by the authorities in such cases. But I get to read so many posts at QL where people seek advice on what steps he could take when an employer hasn't cancelled the RP even after the employee has exited Qatar and they are as such unable to come back on another job. This makes me really wonder if employees still remain at the mercy of employers even after they have ended their contract and left Qatar.
accha: isn't the company required by law now to issue the noc if the employee has completed a year and is on an open contract? i don't know, i'm asking you...i feel if he went to the right labour dept, they'd help him get the noc from the current employer...and if he's leaving the job officially, leaving their sponsorship and exiting qatar, then they would surely have to cancel his rp right? let me know pls...
According to my information, you cannot. You will need an NOC from your present employer and he must also cancel your visa to enable you come on a new work visa.
