The non-compete clause in the contract, is it a standard clause ?
By lifelover85 •
Hi guys, I just got my contract and it involves this clause, is it really standard ? Thanks guys
"This non-compete clause shall extend for a radius of 100 miles of the First Party's present location and shall be in full force and effect during the period of employment and for two years applicable in Qatar only following employment termination, notwithstanding the cause or reason for termination."
It's also what I believe so, but anyway, I don't have any plan stay longer than the contract period though, so I don't really care.
But in case of, is there any agrement which can improve the situation ?
It's just another way to 'enslave' people.
What about soccer coaches? They go from one club to another. Do they have to wait two years??
Pitstop, if a business is good they don't have to fear competition!
It is not normal. a CEO from BMW can immediately take up his new job at Mercedes if he wants, although the two companies ought to be competitors. There is no way such a clause would be accepted by a 'normal' person!
Can I leave after the contract termination in this case ?
Nope nasty, why should be put on hold after 2 years of the contract termination ?
What about an agreement with them ? Does an agreement cancel this clause ?
PITSTOP: I can understand a grace period of up to six months, but TWO years is excessive. In my opinion , this is another way of not giving a NOC
Why unethical? Businesses need to be able to protect themselves.
The clause is at least unethical!
Just strike it through. If you sign it, you accept it. A contract must satisfy BOTH parties.
It really means that they can stop you working for what they deem a competitor for up to two years after you leave them
