IS THIS LEGAL???
By worldexplorer •
I started work at a school in August, and in the 3rd week, around September 11, my father died and I immediately went to my country. Before I left, my employer promised to keep my job and told me to return after Eid, but then informed me 5 days after I left the country that they cancelled my contract for no reason.
Now I am stuck in my country and all of my belongings are in Qatar. I have taken Qatar as my home and do not have my own home anywhere but Qatar.
Needless to say, they have put me in a huge hardship.
Is this legal? Isn't there a bereavement leave in Qatar, especially since it was THEIR idea that I return after Eid? What can I do???
Can't help on the legal front but the fact that you don't have a finished residence visa and was still on the probabtion period, I don't think things are in your favour.
You could go down the human rights route but coming back and making a complaint against their action showing documents to-:
a. prove you had a contract.
b. prove you had a short trip to bury your father (my condolences)
c. submit any letter you sent and received accepting emergency leave.
d. notifying them that you were not paid your salary.
I take it you have a return ticket to qatar that can be used.
Goodluck....
Thank you for your message.
I can come back on a tourist visa no problem. The problem is financial. I hadn't even gotten my first month's salary yet. What they did was totally immoral abandoning me here especially when we had an agreement that I'd return.
I just want to know if I have any legal recourse or not.
Hi,
sorry to hear what happened...i'd say it's not so unusual here!
If you still did not take your medical test hand had your final RP I think you can come back on a tourist visa to pick up your things and to try and talk to your employer.
My suggestion is to contact your embassy here in Doha and figure out if you can come back on a tourist visa.
Cheers

Thank you so much.
I was still in the probation period. Like I said, I had just started the job 3 weeks before. But we had an agreement that I would return after the Eid break.
From your question, it seems you were still on probation, as per the Qatari Law the employer can terminate your employment during probation without having to give any notice or reason for termination.
The questions would be, did you have your Residnce Permit Stamped on your passport? Did your employer cancel your RP? Did you have a signed contract? Does yor employer have published HR policies and Procedure, What do they say? Have you had permission to go on leave? Is it documented? Did you collect your financial entitlements as per your contract? ... etc
What type of communication did you have?
You may always consult a lwayer if you would like to sue them
AS PER WORK LAW of Qatar any employer not to be terminated within the employee leave if he/she has already passed the probation period
