Resignation

Hi..
I have been working here in a Contracting company for the last 7 months. I am an engineering graduate. And i am doing a work which is clerical and HR in nature. So i hav decided to resign from my job here. My contract validity is 2 years and my work permit validity is 1 year. I heard that a person cannot resign from his job within contract period. If i resign from my job, my employer have any right to not accept that? Can he permanently ban me from entering Qatar. Kindly help me..

I resigned my job on 12th Apr 10. Before doing it HR dept told to give 30 days before releiving ie., notice period. So I planned for departure by 12th May. But on receiving my resignation, they now push me out within six days and not ready to pay the salary of 30 days. But Qatar labour law Article 49 says clearly that 30 days period should be paid even if releived early.

I have completed 20 months of service. Also they are telling to settle 11 days salary as gratuity violating Qatar law[ as per Qatar law it comes around 35 days of basic salary. I have my indefinite tripartite contract mentioned with all these EoSB as per Qatar law.

They are not ready to follow many of the contractually agreed conditions. Due to early expulsion I could not pay my bank dues before exiting.

Will I get justice thro' labour department? Friends, pls advise, suggest, share with me.

Hi buddy..I am not quite sure about your reason for asking "If i resign from my job, my employer have any right to not accept that?"... Looks like to me that you are hesitant and/or having a hard time thinking what if my employer ban me permanently??...(however, my opinion only).. Well, as I understood every country has its own designated department dedicated for "Labor"...say Ministry of Labor for example.. They made laws or policy which the government abides... And this means applicable to every place under their area of responsibility.. And as far as I understand, Qatar Labor law has this section that says employee can resign from his work considering he/she render a 1 month notice.. Now, if you are really determined to resign then be it.. Just make sure you will respect the one month notice.. Above, I saw you sayin you can bear the ban (2 years) and the cost of visa and tickets so I dont see any problem... Buddy, resignation is voluntary.. Neither the company nor the goverment can't stop you from resigning..Note that no employers want to pay the employee who is not willing to work anymore.. That's it... But then, I would still suggest to give a second thought.. Who knows there's some good thing waiting for you out there.. I am a mechanical engineer too.. I started my career as an operator in a manufacturing firm.. Now, I am in a position where I can say good enough for me.. Hope it helps mate...

I suggest you just finish at least 12 months so you can get your 21 days Annual leave convertible to cash to help you with your airfare back home. Usually, 1 way back to India is max 1,000 QR only. your employer would probably let you go after a year. If they don't, do something that they would give you a reason to be fired. :D at least, you'll be leaving.

Ask them to give you a copy of your employment contract. The employer must give a copy to the employee. Its your right to have a copy.

If you have completed your probation period then the normal resignation procedure will follow. Check the probation clause if there any extension period. If so, employer will ask you for money. If not, nothing to worry,u can resign. But if you exit the country b4 annual leave, u will have to buy the ticket from your pocket.

If you are not allowed to resign or given an exit, just approach the labor department with a copy of your contract and copy of your resignation letter which you have already submitted. They will help you to leave the country.

Beware.... If you r not given an NOC, then the 2 year ban is applicable in your case.

I am not in probation period now..I have completed 7 months..also i hav submitted resignation last month..but they allowed me a leave instead but now not giving..

better thing is go for emergency leave. I don;t think weather they will accept ur resignation otherelse don;t renew ur RP for the next yr.

Buddy, go through your contract, signed and agreed between you and your employer. Read thoroughly the clauses especially the "Termination of Contract".

In normal course, either party can terminate the contract with 1 to 7days notice subject to the terms and conditions specified on the contract.

If you terminate the contract within the probation period, you will have to pay a lump sum amount to the employer towards the cost of visa, medical, and other expenses if any. Also you will have to buy the ticket from your pocket. However the employer has no right to hold u back but can ban you for 2 years without providing an NOC.

So think twice... gud luck...

I have heard here on QL that some companies have not accepted people's resignations. Each company is different. Should have done your research before taking a job here. Nothing is fair in life and nothing is definitely fair about here.

i can bear 2 years ban..i can bear the cost for visa processing and return ticket also..But my confusion is whether they have right to stop me from resigning..if they doing so if i submit resignation, what can i do for further??

They will accept your resignation given you complete your notice period as stipulated in your work contract. If they don't release you to join another company, you will be required to leave the country and then 2-year ban kicks in.

the problem is now a days there is difficulty to get indian visa..so company is not accepting easily..

If you are going back to your country, what is your problem they cant stop you. If not accepted, then go for emergency leave and dont comeback. What you will do if they terminate you within the Contract period??!! No one can ban you for ever if you dont commint any crime here. the ban period is only 2 years. When you go take till last salary.

are you direct hire or thru an employment agency from your country?

based in my company, with your same situation, they will allow you to resign but you'll have to shoulder your airfare back to your country, deduct some expenses that the company had paid for your papers in Doha and they will definitely BAN you for 2 years time.
