Resignation - Recruitment cost charged by employer. Legal?

Hi everyone,

A friend of mine wants to resign his job. He is under probation period and was locally hired. he worked 2 years before with another employer and his sponsorship was transfered.  It would be appreciated if anyone can could clarrify whether it is legal to charge the recruitment cost by the employer if he resigns during probation period.

His appointment letter indicates the following regarding Probation & Notice of termination.

Probation: Upto 6 months from joining date. Either party can terminate the employment contract after giving 14 working days notice.

Notice of Termination: After probationary period, your contract may be terminated by the employer by giving you 30 days and a 60 days written notice is required from you in case of resignation. If you resign for any reason prior to the completion of 1 year of services, you will be required to refund to the employer all the expenses related to your hiring (Visa fees + Medical + Ticket).

They can't charge even it is written in appointment letter as it contradicts Qatar law.

Why can an employee not be able to give profits to a company before "three" years? Companies do not retain employees if they realize within the first few months the newly-hired employee is no good. That is what is called a "probation period."

What a wild, meaningless, nonsensical statement. But then, some people must just write for the sake of writing, whether it makes sense or not. This post is followed by another post "We need to help our sponsor..." which was enjoyable reading.

the best option is go ask your embassy for advice and to go to the Human Rights commission..

Recruitment charges are the employers expenses.

Notice of termination - is not activated as he has not competed his probation period and resigning during probation period. He can make a case, unfortunately, he may not get NOC and have to go back to HOME country.

It's natural, Our sponsors have to a huge amount to get us a visa & ready to work for him .............. Everything costs my pal ............... A new guys starts giving profit after completion of three years only .................

Sounds like he signed a contract that is used for overseas hires. Since he was hired locally, there was no ticket?
