End of Service Benefit

Hi All,

I am working for an Indian company but located in Qatar since March'2014 under some local sponsor. My company started paying my local salary from June 2014 and before that I was getting my Indian salary and local allowances. Now I am moving back to India next week. My WP visa started in May 2014 and its going to expire next week i.e. May 2015

I have worked for more than a year with my local partner but my company is not giving me End of Service Benefit stating that I have not completed 1 year on my payroll.

Can anyone please suggest if I am eligible for my End of Service Benefit or not?

As i have been working in Qatar under same sponsor for more than a year but my company started my payroll with 1 month delay.

As I have said before I am leaving Qatar so I don't care about my sponsor. And about the money 100 thousand is not a small amount, at-least not for me.

1 year on my sponsor payroll or 1 year on sponsor work permit ? In my case both are different. My Qatar salary started with 1 month delay after the date of issue of my Work Permit.

Wild Turkey, you are absolutely wrong. The minimum is one year, but the fraction point is related to those who spend 1 or more years + few months. So if it is 3 years 4 months, you get the entitlement for 3 years + the fraction for the 4 months.

Article 54 Labor Law

"In addition to any sums to which the worker is entitled to upon the expiry of his service, the employer shall pay the end of service gratuity to the worker who has completed employment of one year or more. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment."

As you can see the end-of-service gratuity shall NOT be less than a three-week wage for every year or "for the fraction of the year in proportion to the duration of employment." That clearly states that the employer MUST pay end-of-service gratuity even if you work less than a year for him!

Kumar , No need to fight with your bosses .......... peopel tried it but at the end it is not worth to loose your sleep for a small amount of money ......... it won't affect your life .... think about your long term benefit from your sponsor ..................
